Yet even in cases dealt with by the lower County Courts it can be arranged<br />

that in political cases no appeal will be filed, as the case of the<br />

right-wing publishing company Grabert proves. In June of 1996 the<br />

owner of that company stood trial at the County Court Tübingen for<br />

having published the book Grundlagen zur Zeitgeschichte, which I had<br />

edited. 125 During that trial the late expert witness Dr. Joachim Hoffmann,<br />

who had been a director at the German government Research<br />

Institute for Military History (Militärgeschichtlichen Forschungsamt) in<br />

Freiburg, testified to the effect that this my book was scientific in nature,<br />

as a result of which it ought to enjoy the protection of freedom of<br />

science according to article 5, paragraph 3, of the German Basic Law.<br />

Yet the County Court Tübingen simply ignored this expert opinion and<br />

sentenced Mr. Grabert anyway. After the latter had filed an appeal<br />

against that decision, the prosecution informed him unofficially that his<br />

publishing company would be subjected to constant house searches and<br />

book confiscation, if he does not withdraw his appeal. And indeed,<br />

since Mr. Grabert had to endure a spring tide of house searches and<br />

book confiscations already during the years 1995/1996, he knew that<br />

this was no empty threat, so he withdrew his appeal. Grabert’s copy<br />

editor told me this several years ago after I had inquired about the state<br />

of the case, since I had hoped that the confiscation of my book would<br />

eventually be dealt with by the German Constitutional High Court.<br />

And such events and general conditions are then claimed to be the<br />

features of a state under the rule of law.<br />

Now to the second quote of the unnamed author:<br />

“Even if you were to speak in your own defense with the eloquence<br />

of Demosthenes [ 126 …] it would not help you in the slightest.<br />

All you could do would be to increase your sentence […].” (1/294)<br />

That’s the same with trials against historical dissidents in Germany,<br />

because if I tried here to prove my historical views, then this would<br />

probably result in the court’s charge of my being incorrigible and even<br />

obdurate, which would lead to an even more severe punishment. Or the<br />

prosecutor would even initiate a new criminal investigation against me,<br />

as I would be committing the same crime of “denial” once more during<br />

a public trial.<br />
