of these interpretations criticism can and ought to be exercised, but a<br />

criticism of a different kind which is aware of the “constructive” nature<br />

of all interpretations and which strives to gain additional insights for its<br />

own conception.<br />

Not the historian but merely the jurist is competent to decide the<br />

question which statement has a denigrating or even insulting character.<br />

But the historian knows that not a few disparagements, even insults can<br />

be found in the literature uniformly recognized as scientific, and he has<br />

to plead for a careful approach in any case. But first of all he will wish<br />

that the Court will become aware about the very complicated and historically<br />

diverse conditionality of an object like “revisionism” before it<br />

hands down a verdict.<br />
