2. General deterrence: To make a deterring example in order that nobody<br />

dare rebel against governmental truth dictates will work only<br />

as long as the disinformation policy toward the public succeeds,<br />

which is increasingly less the case. Publishing the events during this<br />

very trial, for instance, will open the eyes of thousands, tens of thousands,<br />

maybe even hundreds of thousands. At some point in time<br />

this will result in an avalanche effect, as this injustice will drive<br />

people onto the barricades as soon as they learn about it.<br />

3. Resocialization: In fact everything done to me is a crass desocialization.<br />

One constantly destroys the base of my material existence, my<br />

family, and so on. It is not I who is in need of resocialization, but<br />

this German society is, which demands the persecution of peaceful<br />

dissidents or at least lets it happen with a shrug!<br />

4. Faith in the state under the rule of law and in legal security: Anyone<br />

finding out about the conditions and contents of this kind of trial will<br />

lose the last bit of faith in this state. And that includes Jews!<br />

5. Revenge and retaliation: This archaic reason for punishment is the<br />

only one which you can invoke here. He who runs out of arguments<br />

resorts to violence. Hatred and destruction is all this state can do in<br />

the face of peaceful dissent.<br />

Postscriptum<br />

Even the former President of the German Federal Constitutional<br />

High Court and later President of the Federal Republic of Germany<br />

Prof. Dr. Roman Herzog has repeatedly stated that “from time immemorial<br />

there has been a right to resist by those violated and a right to<br />

emergency relief for all citizens” in case of government encroachments<br />

on human dignity and on the human rights. 254 According to Herzog,<br />

each single constitutional article of the Basic Law of the Federal Republic<br />

of Germany – the statutory civil rights also among them – is,<br />

“viewed by daylight,… nothing else but the specific elaboration<br />

on a fundamental principle of the constitutional nature of the state,<br />
