3. I will not file motions asking the Court to consider my historical theses<br />

– for the following reasons:<br />

a. Political: German courts are forbidden by orders from higher up<br />

to accept such motions to introduce evidence, as is stated in Article<br />

97 of the German Basic Law: 56 “Judges are independent and<br />

subject only to the Law.” Please pardon my sarcasm.<br />

b. Opportunistic: Item a) above does not prohibit me from submitting<br />

motions to introduce evidence. However, since they would<br />

all be rejected, it would all be an effort in futility. We should all<br />

spare ourselves this waste of time and energy.<br />

c. Reciprocal: Since present law denies me the right to defend myself<br />

historically and factually, I in turn am denying my accusers<br />

the right to charge me historically and factually on the basis of<br />

the maxim of equality and reciprocity. Thus I consider the prosecution’s<br />

historical allegations to be non-existent.<br />

d. Juridical: In 1543, Nicolaus Copernicus wrote: 57<br />

“If perchance there should be foolish speakers who, together<br />

with those ignorant of all mathematics, will take it upon themselves<br />

to decide concerning these things, and because of some<br />

place in the Scriptures wickedly distorted to their purpose, should<br />

dare to assail this my work, they are of no importance to me, to<br />

such an extent do I despise their judgment as rash.”<br />

No court in the world has the right or the competence to authoritatively<br />

decide scientific questions. No parliament in the world has the<br />

right to use penal law to dogmatically prescribe answers to scientific<br />

questions. Thus it would be absurd for me as a science publisher to ask<br />

a court of law to determine the validity of the works I have published.<br />

Only the scientific community is competent and entitled to do this.<br />
