It is stated as follows in Ni’mat-i-islâm: “Kafâat (being kufw)<br />

means the standards which a woman should expect the man<br />

(she is to marry) to have. The man has to be either superior or<br />

equal to the woman in six respects. A man with a lower<br />

professional status cannot be kufw to a woman holding a higher<br />

profession. This includes a comparison of their salaries or<br />

wages, too. A sinful man, even if his wrongdoings are not widely<br />

known, cannot be kufw to a girl who is sâliha (pious) or even to<br />

a sâlih Muslim’s daughter. The husband ought to have the<br />

financial capacity to pay the mahr-i-mu’ajjal plus the money<br />

enough to support his wife for a month. A man who fulfils this<br />

condition can be kufw to a wealthier woman. These conditions<br />

are to be demanded during the performance of the nikâh. The<br />

nikâh will not be impaired if they cease to exist after the nikâh.<br />

A peasant can be kufw to an urban girl. If a girl’s nikâh is<br />

performed for an amount of mahr less than the amount of mahri-mithl,<br />

her walî can have the mahr complemented or have the<br />

judge cancel the nikâh.”<br />

If a person performs a man’s nikâh or divorces his wife (on<br />

his behalf) though he is not his wakîl, validity of his performance<br />

depends on the man’s accepting or refusing it upon hearing<br />

about it. A slave’s master cannot divorce him from his wife. A<br />

man can make someone else, as well as the wife herself, his<br />

wakîl to divorce his wife (on his behalf). There are three ways of<br />

doing this: The first way, termed Temlîk, is for the man to say to<br />

his wife with the intention of divorce, “Exercise an option<br />

concerning your nafs,” or “You have the choice,” or to say, even<br />

without intention, “Divorce yourself.” In this case, the woman<br />

can divorce herself before any of them leaves the place if he<br />

has not mentioned a certain time, or within the period of time<br />

given if he has appointed a certain time. Please see the thirtysixth<br />

chapter in the second part of the Turkish version.<br />

It is sunnat to serve sweets, fruits or sherbets to those who<br />

are present during the performance of the nikâh and to serve<br />

food rich in meat and desserts for the wedding party, to attend a<br />

wedding feast when you are invited, and to announce a<br />

wedding to acquaintances by beating drums and playing<br />

tambourines.<br />

It is not a condition there to be an imâm or to recite certain<br />

prayers during a performance of nikâh. This is not a nikâh of<br />

imâm (as some ignorant people in Turkey call it). It is an Islamic<br />
