were deprived of the honour endowed by Islam. For their<br />

behaviour shows that they despise and disignore the<br />

commandments and prohibitions of Allâhu ta’âlâ. And this, in its<br />

turn, causes one to lose one’s value and respectability.<br />

As we have stated earlier, women who have become<br />

disbelievers, renegades, cannot be used as jâriyas in the Dârul-harb,<br />

according to reports termed Zâhir. According to reports<br />

called Nawâdir, on the other hand, they can be used as jâriyas,<br />

which fact, too, we have already stated; and we have explained<br />

also that this permissibility can be exploited for the purpose of<br />

giving a renegade woman back to her husband. For reports<br />

termed Nawâdir are weak, untenable. They can be acted upon<br />

only in a useful way (in cases when no one will suffer harm).<br />

Exploitability of Nawâdir reports is only to the extent that they<br />

indicate that women who do not attach importance to the<br />

Sharî’at will lose their honour as a Muslim and will be lowered to<br />

the level of jâriya in the Dâr-ul-islâm and therefore it will be<br />

permissible to look at their head and arms. This license should<br />

not be extended to the assumption that it might be permissible<br />

in the Dâr-ul-harb to seize them and use them like a jâriya or to<br />

have sexual intercourse with them. It is permissible to look at<br />

someone else’s jâriya, yet it is not permissible to have sex with<br />

her without a nikâh. By the same token, it would be an<br />

extremely repulsive mistake to infer that one can have sex with<br />

a prostitute since she has lost her honour as a Muslim by<br />

committing adultery and become like a jâriya. It would be<br />

fornication, and it is disbelief to say that fornication is<br />

permissible.<br />

If one of the husband and wife disappears, the other party<br />

can enter into another marriage as soon he or she is informed<br />

that his or her spouse has become a renegade.<br />

If both the husband and the wife turn renegades in the Dârul-islâm,<br />

the nikâh will not become void. If both of them become<br />

Believers again, the nikâh still will not become void. When both<br />

of them become renegades, the nikâh will become void if one of<br />

them goes to the Dâr-ul-harb. It will become void when the dârs<br />

(countries in which they live) become different. Also, it would<br />

become void if one of them became a Muslim again before the<br />

other one did. (In case a child’s parents are of different<br />

religions), the child’s religion is the same as the better one of<br />

the religions held by the parents living with the child. So is the<br />
