7.16 GILBERT UNIFIED LAND DEVELOPMENT CODE<br />

d. <strong>Land</strong> use.<br />

1) Harmony with land use goals: The extent to which the proposed<br />

amendment is compatible with the land use goals <strong>of</strong> the General Plan<br />

and avoids creation <strong>of</strong> isolated uses that will cause incompatible<br />

community form and a burden on services.<br />

2) Site design: Contribution <strong>of</strong> the proposed amendment to the overall<br />

welfare <strong>of</strong> the immediate area as determined by the following indicators:<br />

(a) Orientations and configuration <strong>of</strong> conceptual land uses; (b)<br />

Efficiency <strong>of</strong> traffic circulation in the area:<br />

(c) Compliance with bufferyard standards; and<br />

(d) Continuity <strong>of</strong> design with adjacent properties.<br />

3) Environmental: The ability <strong>of</strong> the community to sustain a balance <strong>of</strong><br />

resources, including physical and cultural, to meet the demands <strong>of</strong><br />

present and future residents. The applicant shall provide mitigation<br />

measures, when necessary, to address to development's impact on air,<br />

water, land and cultural resources. The applicant shall also evaluate<br />

<strong>of</strong>f-site environmental impacts on the proposed development, as well<br />

as specific impacts the development may have on other sites within an<br />

approximate half-mile radius.<br />

7.2 Planning and Zoning Commission.<br />

The Planning and Zoning Commission is created to provide General Plan analysis and<br />

recommendations consistent therewith to the Council. Its purpose is to review all aspects <strong>of</strong><br />

proposed rezoning, <strong>Code</strong> amendments and other development entitlement requests including,<br />

but not limited to, present and projected growth <strong>of</strong> the <strong>Town</strong>, and the relationship <strong>of</strong> the<br />

development to the surrounding environment and the community regarding land use and zoning.<br />

7.21 Hearings by Planning and Zoning Commission on proposed amendments.<br />

All applications for amendment <strong>of</strong> the <strong>Code</strong> shall first be submitted to the Planning and<br />

Zoning Commission. The Planning and Zoning Commission shall hold a public hearing in<br />

relation to the proposed amendment at which citizens shall have an opportunity to be heard. The<br />

Planning and Zoning Commission shall then make a recommendation to the <strong>Town</strong> Council and<br />

the <strong>Town</strong> Council may adopt the Planning and Zoning Commission's recommendation without<br />

holding a second public hearing unless:<br />

A. A member <strong>of</strong> the public objects to adoption <strong>of</strong> the Planning and Zoning Commission<br />

recommendation or requests a second public hearing prior to action on said application by<br />

the <strong>Town</strong> Council.<br />

B. A formal protest has been filed (See: Section 7.11-d) or, if, for any reason, the <strong>Town</strong><br />

Council wishes to review the Commission's recommendation, a second hearing shall be<br />

held.<br />
