8.74 GILBERT UNIFIED LAND DEVELOPMENT CODE<br />

8.74 Any final decision to approve or deny a request shall be in writing and set forth the reasons and<br />

substantial evidence for the decision.<br />

8.8 Permit term and limitations.<br />

8.81 An Administrative Use Permit or Use Permit for a WCF shall have a term <strong>of</strong> ten (10) years, except<br />

an Administrative Use Permit for a temporary wireless communications facility shall have a term<br />

<strong>of</strong> up to one hundred-twenty (120) days, subject to termination or expiration as provided for in this<br />

Article or under the specific conditions <strong>of</strong> the Permit.<br />

8.82 Permittee may apply for a renewal permit under the <strong>Code</strong> as it may exist at such time within six (6)<br />

months prior to expiration <strong>of</strong> its existing permit, except no renewal <strong>of</strong> an Administrative Use<br />

Permit for a temporary wireless communications facility shall be allowed. Renewal <strong>of</strong> an<br />

administrative use permit for a public safety communications tower shall be granted in successive<br />

terms for up to thirty (30) years, where permittee demonstrates compliance with applicable rules<br />

and regulations, existing permit conditions, and continued need for the public use.<br />

8.83 The term <strong>of</strong> a Use Permit for a monopole with co-located facilities shall be extended to be<br />

concurrent with the term <strong>of</strong> a subsequently issued Administrative Use Permit for the co-located<br />

facilities.<br />

8.84 Any Administrative Use Permit or Use Permit issued pursuant to this Article shall expire<br />

automatically if the use is not commenced within one (1) year after the date <strong>of</strong> approval <strong>of</strong> such<br />

permit, under the circumstances set forth in Section 7.15 <strong>of</strong> this <strong>Code</strong>, provided however a Master<br />

Administrative Use Permit or Master Use Permit shall expire automatically three (3) years after<br />

the date <strong>of</strong> approval <strong>of</strong> such permit under the same circumstances set forth in Section 7.15.<br />

8.85 If use <strong>of</strong> the facility is discontinued for over ninety (90) days, the permit shall expire and permittee<br />

must remove the facility or the <strong>Town</strong> may cause the facility to be removed at the expense <strong>of</strong> the<br />

permittee/owner <strong>of</strong> the facility.<br />
