GILBERT UNIFIED LAND DEVELOPMENT CODE<br />

C. Site plan. The site plan shall be submitted for review by the Planning Commission, Design<br />

Review Board and <strong>Town</strong> Council and shall conform to Article IX, Site Plan Review. In addition,<br />

it shall address the following:<br />

1. The area and location <strong>of</strong> open space. Open space should be provided as outlined in this section <strong>of</strong> the<br />

<strong>Code</strong> or an acceptable alternative amenity package combining open space with features such as<br />

swimming pools, community centers, community gardens, fitness centers or interpretive centers<br />

should be presented with the site plan. Golf courses, for purposes <strong>of</strong> this ordinance, will not be<br />

considered in an open space calculation, unless it is demonstrated that the course is dedicated for<br />

use and benefit by the project residents.<br />

2. Written designation <strong>of</strong> responsibility for ownership and maintenance <strong>of</strong> common driveways,<br />

open spaces and commonly owned areas associated with each clustered group <strong>of</strong> single family<br />

units.<br />

D. Height requirements. The height <strong>of</strong> buildings shall not exceed thirty (30) feet nor two (2) stories.<br />

E. Yard regulations.<br />

1. There shall be a minimum ten (10) foot separation between dwelling units in all directions.<br />

2. Accessory structures shall be setback a minimum <strong>of</strong> five (5) feet from the side or rear<br />

property line. No accessory structures are allowed in the front yard.<br />

F. Intensity <strong>of</strong> use regulations.<br />

1. Lot coverage: The main building and accessory buildings on a lot shall not occupy more than:<br />

A. Fifty (50) percent for two-story.<br />

B. Sixty (60) percent for single-story.<br />

2. Lot area: No lot shall have a net lot area less than two thousand (2,000) square feet. (Ord.<br />

No. 1171, § I, 5-11-99)<br />

1.4 Multi-Family Zoning Districts.<br />

Multi-family residential classifications are intended to increase the <strong>Town</strong> <strong>of</strong> <strong>Gilbert</strong>'s variety <strong>of</strong> housing<br />

opportunities and their range <strong>of</strong> affordability. The use <strong>of</strong> land for accommodating more intense residential<br />

development, according to the adopted General Plan, accommodates individuals and families who do not require<br />

single-family, detached living arrangements.<br />

Location <strong>of</strong> multi-family dwelling designations is determined by findings <strong>of</strong> adequate access, utility<br />

capacity and compatibility with adjacent land uses. These districts may act as transitional density areas between<br />

single-family residences and more intense, non-residential uses. Siting arrangements for multifamily<br />

developments shall include ample on-site open space and assurance that vehicular ingress and egress does not<br />

unduly impact traffic circulation in residential neighborhoods <strong>of</strong> lesser density. Opportunity for integration with<br />

pathway systems and close to major arterials for use <strong>of</strong> future mass transit facilities shall also be included in<br />

siting considerations.<br />
