Glare," and, as such, that public record entitled "The <strong>Unified</strong> <strong>Land</strong> <strong>Development</strong> <strong>Code</strong> <strong>of</strong> <strong>Town</strong> <strong>of</strong><br />

<strong>Gilbert</strong>, Arizona, Chapter II, Article XI, Section 11.22(A) Light and Glare," is hereby referred to,<br />

adopted and made a part here<strong>of</strong> as though fully set forth in this Ordinance.<br />

Section II.<br />

Providing for Repeal <strong>of</strong> Conflicting Ordinances.<br />

All ordinances and parts <strong>of</strong> ordinances in conflict with the provisions <strong>of</strong> this<br />

Ordinance or any part <strong>of</strong> the <strong>Code</strong> adopted herein by reference are hereby repealed.<br />

Section Ill.<br />

Providing for Severability.<br />

If any section, subsection, sentence, clause, phrase or portion <strong>of</strong> this Ordinance or any<br />

part <strong>of</strong> the <strong>Code</strong> adopted herein by reference, is for any reason held to be invalid or unconstitutional.<br />

by-the decision <strong>of</strong> any court <strong>of</strong> competent jurisdiction, such decision shall not affect the validity <strong>of</strong> the<br />

remaining portions there<strong>of</strong>.<br />

Section IV.<br />

Providing for Penalties.<br />

a. Civil Penalties. Upon a finding that a person is responsible for a civil<br />

violation <strong>of</strong> this subsection, a civil sanction <strong>of</strong> not less than one hundred dollars ($100) nor more than<br />

five hundred dollars ($500) for each violation shall be imposed.<br />

b. Each Day Separate Violation. Each day in which a violation <strong>of</strong> this<br />

subsection continues or the failure to perform any act or duty required by this subsection or by the<br />

code enforcement <strong>of</strong>ficer in accordance with this subsection continues shall constitute a<br />

separate civil <strong>of</strong>fense.<br />

c. Habitual Offender. A person who commits a violation <strong>of</strong> this subsection<br />

after previously having been found responsible for committing three (3) or more civil violations <strong>of</strong> this<br />

subsection within a twenty-four (24) month period, whether by admission, by payment <strong>of</strong> the fine, by<br />

default, or by judgment after hearing, shall be guilty <strong>of</strong> a Class 1 misdemeanor. The <strong>Gilbert</strong> town<br />

prosecutor is authorized to file a criminal misdemeanor complaint in the <strong>Town</strong> Court against habitual<br />

<strong>of</strong>fenders who violate this subsection. For purposes <strong>of</strong> calculating the twenty-four (24) month period<br />

under this paragraph, the dates <strong>of</strong> the commission <strong>of</strong> the <strong>of</strong>fenses<br />

are the determining factor.<br />

PASSED AND ADOPTED by the Common Council <strong>of</strong> the <strong>Town</strong> <strong>of</strong> <strong>Gilbert</strong>,<br />

Arizona, this 24th day <strong>of</strong> October<br />
