GENERAL REGULATIONS 2.67<br />

2.67 Group homes for the handicapped are permitted in all single-family zones (Zones AG,<br />

RI-43, RI-35, RI-20, RI-I5, RI-IO, RI-B, RI-7, RI-5) and multi-family zones (R-2,R-3, R-<br />

4, R-TH) and other zones as specified by the <strong>Unified</strong> <strong>Land</strong> <strong>Development</strong> <strong>Code</strong>, so long<br />

as such homes are in compliance with the following conditions:<br />

A. A maximum <strong>of</strong>ten (10) residents per home, not including staff.<br />

B. No sign, graphics, display or other visual means <strong>of</strong> identifying the group home shall be<br />

visible from a public street.<br />

C. Compliance with all applicable building and fire safety regulations. If a group home<br />

has one or more non-ambulatory residents, building code requirements apply in<br />

addition to those applicable to group homes with no non-ambulatory residents.<br />

D. A separation between such homes <strong>of</strong> a minimum <strong>of</strong> one-thousand two-hundred (1,200)<br />

feet for the purpose <strong>of</strong> main-streaming handicapped residents into the surrounding<br />

neighborhood.<br />

E. Evidence <strong>of</strong> any license, certifications, or registration required for the group home by a<br />

state or federal agency.<br />

F. Registration with the <strong>Gilbert</strong> Department <strong>of</strong> Community <strong>Development</strong>.<br />

G. Large and/or multiple trash receptacles not usually found in the residential area shall<br />

be blocked from public view.<br />

H. No group home shall house any person whose tenancy would constitute a direct threat<br />

to the health or safety <strong>of</strong> other individuals or would result in substantial physical<br />

damage to the property <strong>of</strong> others.<br />

Notwithstanding the foregoing, if the State has adopted laws or rules for the regulation <strong>of</strong><br />

a specific type <strong>of</strong> home, such as a group home for the developmentally disabled pursuant to<br />

A.R.S. 36-582, or an adult care home pursuant to A.R.S. 36-448.09, then any such State law<br />

or rule shall apply in addition to the conditions listed herein and shall preempt any<br />

conflicting condition listed herein.<br />
