1.42 GILBERT UNIFIED LAND DEVELOPMENT CODE<br />

D. Intensity <strong>of</strong> use.<br />

1. Maximum density: The maximum density in the R-3 District shall not exceed eighteen<br />

(18) units for each net acre <strong>of</strong> land.<br />

2. Minimum property size: Each parcel or lot shall be a minimum net lot size <strong>of</strong> twenty<br />

thousand (20,000) square feet unless such a lot has been lawfully established and<br />

recorded prior to the adoption <strong>of</strong> this requirement.<br />

E. Specific requirements.<br />

1. Approvals:<br />

a. <strong>Development</strong>s <strong>of</strong> one acre or greater in net site area within the R-3 district<br />

shall submit a site plan to the '<strong>Town</strong> Council for approval prior to issuance <strong>of</strong><br />

building permits.<br />

b. Site Plans shall show all parking areas, loading and refuse areas, drives, access<br />

ways, locations and dimensions <strong>of</strong> buildings, elevations and floor plans <strong>of</strong><br />

buildings, and landscaping.<br />

c. If such site plans are accompanied by a request for a Use Permit, the<br />

application shall require a public hearing before the Planning Commission and<br />

the <strong>Town</strong> Council.<br />

2. Open space: Open space is a major element in establishing the character <strong>of</strong> a<br />

development. The purpose <strong>of</strong> this section is to provide meaningful open space within the<br />

project as well as a landscaped setting along public streets.<br />

a. The amount <strong>of</strong> common open space provided in a project shall equal or exceed<br />

the total "floor area" <strong>of</strong> all buildings up to a maximum <strong>of</strong> forty-five (45)<br />

percent <strong>of</strong> the net lot area. No provision in this section shall require more than<br />

forty-five (45) percent <strong>of</strong> the net lot area to be devoted to common open space<br />

although the <strong>Town</strong> encourages developers to exceed the maxi-<br />

mum requirement.<br />

b. "Common open space" is defined as that portion <strong>of</strong> a parcel not covered by<br />

buildings (included patios, balconies, or other private open space), parking<br />

areas, or driveways. Such areas shall be devoted to the purpose <strong>of</strong> outdoor<br />

living space for the residents and may include lawn areas, walkways, sitting<br />

areas, courtyards, and outdoor recreation facilities. Buildings, structures, or<br />

other impervious surfaces devoted to meaningful recreation or open space uses<br />

shall be considered as open space.<br />

c. "Floor area" shall include all areas for residential use on all floors measured<br />

from the outside faces <strong>of</strong> exterior walls including balconies, entryways,<br />

stairwells, management <strong>of</strong>fices, lobbies, patios and any other space used for<br />

habitation.<br />

d. A minimum <strong>of</strong> forty (40) percent <strong>of</strong> the required common open space shall be<br />

provided along the public street frontage in the form <strong>of</strong> landscaping setback.<br />

Such areas shall not be required to exceed fifty (50) feet in width nor shall<br />
