GILBERT UNIFIED LAND DEVELOPMENT CODE<br />

revision to an approved landscape plan; (4) minor changes to circulation plans; and (5) changes to<br />

approved colors and materials in an existing or approved project. The Planning Director may<br />

approve a Site Plan for a small project with stipulations necessary to protect the public interest or<br />

he may refer a small project to the Design Review Board for their review.<br />

B. The Planning Director may find that special conditions require one or more <strong>of</strong> the following:<br />

1. Limited vehicular access.<br />

2. Walls, fences and screening devices.<br />

3. Off-site improvements in public right-<strong>of</strong>-way adjacent to the subject property.<br />

C. The Planning Director's decision shall be final unless the applicant files, in writing, within five (5)<br />

working days <strong>of</strong> the receipt <strong>of</strong> the decision a request that a public hearing be scheduled before the<br />

Design Review Board. Further appeal from the Design Review Board decision may be filed<br />

within ten (10) working days in accordance with Section 7.4.<br />

For small projects, if no changes are required to be made to the Preliminary Site Plan, it may be<br />

approved as the Final Site Plan.<br />

10.13 Review Design Review Board<br />

A. Except for small projects approved pursuant to Section 10.12, the Design Review Board shall<br />

review applications for Site Plan approval in accordance with this Article and procedures set forth<br />

in paragraph 7.4.<br />

1. The Design Review Board shall hold a noticed public hearing for site plan approvals.<br />

2. The applicant, the Planning Director, the <strong>Town</strong> Manager, any member <strong>of</strong> the <strong>Town</strong> Council or an<br />

aggrieved person may appeal any decision <strong>of</strong> the Commission to the <strong>Town</strong> Council by filing<br />

written notice <strong>of</strong> the appeal to the <strong>Town</strong> Clerk within ten (10) calendar days from the date <strong>of</strong><br />

the Commission's action. The <strong>Town</strong> Council shall have the authority to uphold, modify, or<br />

overrule the decision <strong>of</strong> the Commission. The decision <strong>of</strong> the <strong>Town</strong> Council shall be final<br />

B. The Design Review Board may find that special conditions require specific stipulations for<br />

approval Stipulations approved by the Design Review Board shall be set forth in the minutes <strong>of</strong><br />

the Board.<br />

1. A Preliminary Site Plan shall be filed with the Planning Department. The Planning<br />

Department shall prepare recommendations for the Design Review Board. The Design<br />

Review Board shall review the Preliminary Site Plan for compliance with applicable<br />

ordinances and design requirements. The Design Review Board may, at its option, approve<br />

the Preliminary Site Plan as a Final Site Plan if all requirements <strong>of</strong> the <strong>Town</strong> are met. If<br />

modifications are required to be made prior to final approval, the applicant shall file its Final<br />

Site Plan with the Planning Department and the Design Review Board<br />
