ZONES (DISTRICT CLASSIFICATIONS)<br />

1.39A (R-CH) Single-family, Cluster Home.<br />

This zoning district is intended to provide for efficient use <strong>of</strong> land and facilities by single-family detached<br />

dwellings taking into consideration existing conditions, including present use <strong>of</strong> land, future land use needs and<br />

the ability to adequately provide public services. Other considerations for the district should be:<br />

* Provision <strong>of</strong> attractive neighborhoods that maintain the rural character <strong>of</strong> <strong>Gilbert</strong>.<br />

* Provision <strong>of</strong> open space for private community services.<br />

* Provision <strong>of</strong> diversity in housing lifestyles.<br />

The minimum lot area is two thousand (2,000) square feet. The principal land use classification on the<br />

General Plan for this district is Medium High Density Residential (4--8 du/ac, target 6 du/ac). It can also be<br />

used in Medium Density Residential (0--4 du/ac, target 3.5 du/ac). To qualify as an R-CH district in the<br />

Medium Density Residential district, the project must meet the following:<br />

1. All units must be clustered in a designated development area on lot sizes specified in this section <strong>of</strong> the<br />

<strong>Code</strong> and cannot exceed a net development area density <strong>of</strong> eight (8) du/ac. The development area shall not<br />

exceed fifty (50) percent <strong>of</strong> the total site area and must be shown on a proposed development plan submitted<br />

for zoning approval. The balance <strong>of</strong> the area shall be developed as open space with specified passive or<br />

active amenities.<br />

A. Area configuration. An R-CH shall not exceed sixty (60) percent <strong>of</strong> a designated MH land use<br />

category on the General Plan.<br />

B. Permitted uses.<br />

1. Single-family dwellings.<br />

2. Accessory uses and buildings customarily incidental to single-family dwellings on the same lot,<br />

provided no accessory building shall be used for sleeping or living purposes.<br />

3. Home occupations.<br />

4. Schools, colleges, and churches, or similar places <strong>of</strong> worship, including parish houses,<br />

parsonages, rectories, convents and dormitories accessory thereto.<br />

5. Public utility buildings and facilities when necessary for serving the surrounding area; provided<br />

that no business <strong>of</strong>fices open to the public and no repair or storage facilities are maintained<br />

therein.<br />

6. Publicly or privately owned and operated parks, playgrounds and community buildings, and<br />

other recreational uses intended for use primarily by the residents <strong>of</strong> the subdivision.<br />

7. Group homes for the handicapped, so long as the supplemental conditions <strong>of</strong> Section 2.67 are<br />

complied with.<br />

8. Uses permitted by Use Permit: Temporary structures for use by private schools or churches or<br />

similar places <strong>of</strong> worship. Temporary structures may only be used during the term <strong>of</strong> the permit<br />

and there after shall be removed.<br />
