11.22 GILBERT UNIFIED LAND DEVELOPMENT CODE<br />

2. Noxious discernible odors shall be eliminated from exhaust to the extent practicable<br />

through the use <strong>of</strong> filters and/or other means in common use.<br />

3. Refuse containers shall be located away from adjacent properties when such locations are<br />

practical.<br />

4. Refuse which may emit odors shall be stored within air tight containers such as sealed<br />

plastic bags or other containers acceptable to the <strong>Town</strong>.<br />

11.23 Building setbacks and height limits.<br />

A. To protect against the intrusion <strong>of</strong> privacy <strong>of</strong> residential uses from proposed new non-residential<br />

and new multi-family developments, including intrusion from upper levels; to assure adequate<br />

access to sunlight and open air; to allow for the provision <strong>of</strong> landscaped bufferyards, and to<br />

protect opportunities for solar access; all land uses located in non-residential and multi-family<br />

zoning districts which are adjacent to parcels zoned or designated in the General Plan for singlefamily<br />

or multi-family residential uses shall meet the building setbacks as described below.<br />

Parking areas are permitted within the building setback provided that they do not encroach into<br />

or reduce the required landscaped bufferyard except that in the NS and NCC districts parking<br />

areas shall not be allowed to encroach into the setback.<br />

C. If truck delivery or loading areas are planned between a proposed building and an existing or<br />

anticipated residential use, additional screening and noise mitigation shall be used adjacent to<br />

loading areas.<br />

D. Additional setbacks may be required for uses within the above zoning classification which<br />

require a Use Permit.<br />
