1.61 GILBERT UNIFIED LAND DEVELOPMENT CODE<br />

2. Retail commercial operations, when the product sold at retail is the product which<br />

is manufactured as the primary use, shall not exceed ten (10) percent <strong>of</strong> the gross<br />

floor area. A retail commercial operation is directly related to the primary industrial<br />

use when the product sold at retail is the product which is manufactured or stored<br />

as the primary use.<br />

3. Uses permitted by Use Permit:<br />

B. Approval process.<br />

a. Retail commercial operations directly related to the primary industrial use,<br />

may exceed ten (10) percent <strong>of</strong> the gross floor area upon securing a Use<br />

Permit as outlined in Section 7.15.<br />

b. Any use or similar use indicated as requiring a Use Permit under the I-B<br />

column <strong>of</strong> the Table <strong>of</strong> Permitted Uses for Non-Residential Districts shall<br />

require a Use Permit as outlined in Section 7.15.<br />

Site Plan approval shall be required in accordance with Chapter II prior to<br />

construction.<br />

C. Performance standards. Uses in this district shall be in full conformance with the standard <strong>of</strong> this<br />

and other applicable sections <strong>of</strong> this <strong>Code</strong>:<br />

1. At least fifty (50) percent <strong>of</strong> the gross floor area shall be devoted to <strong>of</strong>fice or<br />

research. Not more than twenty-five (25) percent <strong>of</strong> the employees shall be<br />

engaged in manufacturing processing at anyone time.<br />

2. All activity shall be conducted within a completely enclosed building.<br />

3. Principal vehicle access to and from the site shall be via a primary driveway.<br />

4. Noise emitted from the use shall not exceed the noise level <strong>of</strong> the abutting district<br />

or the street abutting the use, whichever is greater. Measurement <strong>of</strong> noise levels<br />

shall be made at the zoning district boundary.<br />

5. See Section 1.65, Table <strong>of</strong> Bulk, Building and <strong>Land</strong>scape Setback Requirements<br />

for the building and landscape setbacks, height, building coverage requirements,<br />

and the minimum and maximum lot area.<br />

6. Permitted uses shall not cause to be exhausted or emitted into the air beyond the<br />

industrial district wherein such use is located, smoke, soot, dust, fumes or other<br />

gases, vibration. No uses shall endanger surrounding neighborhoods through the<br />

risk <strong>of</strong> explosion or radiation.<br />

7. All loading shall be from the rear side <strong>of</strong> the building, but not facing a public street<br />

or residential neighborhood. Loading on the side or front may be considered if<br />

access, safety and aesthetics are improved.<br />

8. All buildings must be <strong>of</strong> reinforced concrete or masonry construction. Corrugated<br />

metal buildings shall not be permitted.<br />
