8.6 GILBERT UNIFIED LAND DEVELOPMENT CODE<br />

include specific information as to location, height, and design <strong>of</strong> each facility. The <strong>Town</strong> may<br />

share such information with other applicants seeking to locate WCFs within the Service Area,<br />

in order to encourage co-location.<br />

B. Report on alternatives: A report explaining why the WCF is needed at the requested location. If<br />

applicant is seeking to construct a new monopole, applicant shall explain why co-location or location<br />

on another kind <strong>of</strong> support structure is not feasible, including efforts made to develop such an<br />

alternative. If the <strong>Town</strong> has requested that the applicant co-locate its WCF on a site, applicant shall<br />

explain why co-location is not feasible, including efforts made to develop such an alternative.<br />

C. Plans for the WCF: Plans should include a diagram <strong>of</strong> the proposed facility and antennae, including<br />

height, shape, size and nature <strong>of</strong> construction. The plans for a monopole must show that it is<br />

structurally able to accommodate the applicant and at least one (1) other similar telecommunications<br />

provider. The plans should include a diagram showing the separation between the proposed WCF and<br />

any existing WCF(s) on the same support structure or site, if co-location is planned.<br />

D. A site/landscaping plan showing the specific placement <strong>of</strong> the WCF on the site, including<br />

setbacks from adjacent property lines; showing the location <strong>of</strong> existing structures, trees, and<br />

other significant site features; and indicating type and locations <strong>of</strong> plant materials used to<br />

screen WCF components and the proposed color(s) for the WCF.<br />

E. Photo-simulations <strong>of</strong> the view <strong>of</strong> the proposed facility from residential properties and public<br />

rights-<strong>of</strong>-way at varying distances.<br />

F. Applicant for a new monopole permit shall post a cash or surety bond with the <strong>Town</strong> Clerk in<br />

an amount determined by the <strong>Town</strong> to cover removal costs <strong>of</strong> the pole should the<br />

applicant/owner fail to remove the pole within thirty (30) days following termination or<br />

expiration <strong>of</strong> the permit. The cash or surety bond shall be released upon removal <strong>of</strong> the pole by<br />

the owner. A surety bond shall be limited to five (5) years, at which time the <strong>Town</strong> may require<br />

renewal for a period which extends at least sixty (60) days beyond the ending date <strong>of</strong> the<br />

permit term. The cash or surety bond shall be governed by a standardized agreement form<br />

provided by the <strong>Town</strong> and executed by the owner <strong>of</strong> the monopole. The <strong>Town</strong> in its discretion<br />

may require posting <strong>of</strong> a cash or surety bond, or other financial arrangements to ensure timely<br />

removal <strong>of</strong> a public safety communications tower following termination or expiration <strong>of</strong> the<br />

permit.<br />

G. Prior to submitting an application to the Planning Director for an administrative Use Permit,<br />

applicant shall provide written notice <strong>of</strong> the proposed WCF in a standardized form provided by<br />

the Planning Director by first class mail to all property owners within three-hundred (300) feet<br />

<strong>of</strong> the proposed WCF site. Applicant shall submit to the Planning Director a copy <strong>of</strong> the notice<br />

and a list <strong>of</strong> persons and addresses to whom it was mailed.<br />
