8.86 Permittee shall maintain the WCF, including paint and landscaping, to standards imposed<br />

by the <strong>Town</strong> at the time <strong>of</strong> granting the permit. If the permittee fails to maintain the facility,<br />

the <strong>Town</strong> may undertake maintenance at the expense <strong>of</strong> the permittee or terminate the<br />

permit.<br />

8.87 The applicant/permittee shall notify the <strong>Town</strong> in writing <strong>of</strong> all changes in ownership <strong>of</strong> the<br />

facility within sixty (60) days <strong>of</strong> the change.<br />

8.9 Applicability; waiver <strong>of</strong> requirements.<br />

8.91 The requirements <strong>of</strong> this Article apply to all new WCFs and the renewal, expansion and/or<br />

alteration <strong>of</strong> any existing WCFs; provided that an in-kind or smaller replacement <strong>of</strong><br />

transmission equipment will only require a written notification to the <strong>Town</strong>.<br />

8.92 The <strong>Town</strong> Council may waive or modify requirements <strong>of</strong> this Article upon finding that<br />

strict compliance would result in noncompliance with applicable federal or state law. (Ord. No.<br />
