Reviewing agencies shall be requested to transmit their recommendations to the<br />

Department in writing. The Department shall summarize the reviewing <strong>of</strong>fices'<br />

recommendations, prepare a staff report regarding the project and present it to the<br />

Planning and Zoning Commission.<br />

C. Preliminary plat approval.<br />

The preliminary plat shall be submitted to the Planning and Zoning Commission, which<br />

shall hold a public hearing after notice as required in paragraph D below, at which time<br />

members <strong>of</strong> the public shall have an opportunity to be heard. Following action <strong>of</strong> the<br />

Commission, one (1) copy <strong>of</strong> the preliminary plat, together with a written report, shall be<br />

returned to the subdivider describing any recommended changes and stating the action <strong>of</strong> the<br />

Commission. A revised preliminary plat shall be submitted to the Planning staff incorporating<br />

the Commission's revisions, prior to scheduling a final plat for <strong>Town</strong> Council approval.<br />

D. Notice.<br />

Notice <strong>of</strong> such Planning and Zoning Commission public hearing shall be published once in<br />

a newspaper <strong>of</strong> general circulation in the <strong>Town</strong> <strong>of</strong> <strong>Gilbert</strong>, and shall be posted within the area<br />

included in the preliminary plat. Both such publication and posting shall not be less than<br />

fifteen (15) days before the Planning and Zoning Commission meeting. It shall be the<br />

responsibility <strong>of</strong> the applicant to maintain the posting. A posted notice shall be printed so that<br />

the following are visible from a distance <strong>of</strong> one hundred (100) feet: The words ''Preliminary<br />

Plat", the present zoning district classification, and the date and time <strong>of</strong> the hearing.<br />

E. Appeal.<br />

The applicant, the Planning Director, the <strong>Town</strong> Manager, any member <strong>of</strong> the <strong>Town</strong><br />

Council or an aggrieved person may appeal any decision <strong>of</strong> the Commission to the <strong>Town</strong> Council<br />

by filing written notice <strong>of</strong> the appeal to the <strong>Town</strong> Clerk within ten (10) calendar days from the<br />

date <strong>of</strong> the Commission's action. The <strong>Town</strong> Council shall have the authority to uphold, modify, or<br />

overrule the decision <strong>of</strong> the Commission. The decision <strong>of</strong> the <strong>Town</strong> Council<br />

shall be final. .<br />

9.13 Final plat/recorded plat.<br />

This stage includes the final design <strong>of</strong> the subdivision, with intended engineering improvements, and<br />

submittal <strong>of</strong> the plat and plans by the subdivider, for review and action by the <strong>Town</strong> Departments and<br />

Council, respectively. Refer to Chapter III for engineering specifications.<br />

A. Submittal requirements. The pre-final plat and three (3) prints there<strong>of</strong> shall be submitted to the<br />

Engineering Department for consideration within one (1) year from date <strong>of</strong> Council action on<br />

the preliminary plat. Otherwise, preliminary approval shall become null and void unless an<br />

extension <strong>of</strong> time is applied for and granted by the Commission.<br />
