establishing noise attenuation requirements applicable to noise sensitive uses in new<br />

projects in Overflight Area 2, and by requiring notification to future owners and<br />

occupants <strong>of</strong> possible noise impacts on noise sensitive uses in new projects in<br />

Overflight Areas 2 and 3 <strong>of</strong> the Williams Gateway Airport Overlay District.<br />

B. Definitions<br />

For the purposes <strong>of</strong> this section, the following words and terms shall have the<br />

following meanings:<br />

1. "Airport" means the Williams Gateway Airport owned and operated by the<br />

Williams Gateway Airport Authority.<br />

2. "DNL" means the 24-hour average sound level, in A-weighted decibels,<br />

obtained after the addition <strong>of</strong> ten decibels to sound levels for the periods<br />

between 10 p.m. and 7 a.m. as averaged over a span <strong>of</strong> one year. It is the FAA<br />

standard metric for determining the cumulative exposure <strong>of</strong> individuals to noise.<br />

3. "New project" means a project with the following status <strong>of</strong> development as <strong>of</strong><br />

October 16,2003 (the effective date <strong>of</strong> this ordinance): 1) no preliminary plat<br />

has been approved; or 2) a preliminary plat has expired; or 3) no preliminary<br />

design review site plan has been approved; or 4) a preliminary design review<br />

site plan has expired.<br />

4. "Noise sensitive uses" means single family or multifamily residential uses,<br />

hospitals, nursing homes, places <strong>of</strong> worship, libraries, public and private schools, and<br />

daycare centers.<br />

5. "Overflight Areas" means those areas designated on the Williams Gateway<br />

Airport Overlay District Map as overflight areas. Overflight areas are divided into<br />

Overflight Areas 1, 2 and 3.<br />

6. "Project" means either, as applicable, a subdivision with boundaries that<br />

have been or will be established by a final subdivision plat or a site with<br />

boundaries depicted on' a site plan.<br />

7. "Williams Gateway Airport Overlay District" means the area designated within<br />

the boundary <strong>of</strong> the Williams Gateway Airport Overlay District<br />

Map as the Williams Gateway Airport Overlay District. '
