2.16 GILBERT UNIFIED LAND DEVELOPMENT CODE<br />

2.16 No space needed to meet the width, yard, area, coverage, parking, or other requirements <strong>of</strong> this<br />

<strong>Code</strong> for a lot or building may be sold or leased away from such lot or building.<br />

2.17 No parcel <strong>of</strong> land which has less than the minimum width and area requirements for the zone in<br />

which it is located may be cut <strong>of</strong>f from a larger parcel <strong>of</strong> land for the purpose, whether<br />

immediate or future, <strong>of</strong> building or development as a lot except by Permit <strong>of</strong> the Board <strong>of</strong><br />

Adjustment.<br />

2.18 A large lot or parcel <strong>of</strong> land may be subdivided into smaller lots provided such smaller lots<br />

conform to the lot size limitations <strong>of</strong> the district in which the lots are situated; however, if a<br />

parcel is divided into more than four (4) lots, the Building Inspector shall not issue permits for<br />

same unless a recorded plat <strong>of</strong> such subdivision shall be filed.<br />

A. No lot shall be divided in such a way that any division <strong>of</strong> such lot shall contain more<br />

dwelling units than are permitted by the Zoning Regulations <strong>of</strong> the district in which<br />

such lot is situated.<br />

B. If, after dividing the area <strong>of</strong> a lot by the zoning requirements for the district in which the lot<br />

is situated, there is a remainder which is less than that required for a unit but more than<br />

eighty-five (85) percent <strong>of</strong> that amount, then one additional dwelling unit may be built on<br />

such lot.<br />

2.2 Buffering criteria.<br />

2.21 In an NCC, C-1, C-2, 1-1, 1-2, or 1-3 District, property which is in common with or separated<br />

only by an alley, from any lot line in any Residence District, the developer shall construct a<br />

masonry wall, six (6) feet in height, (or other suitable divider to be approved by the <strong>Town</strong><br />

Council) along the common lot line.<br />

2.22 On an interior lot, in any Residence District, having no access to an alley and where the garage<br />

or carport is not attached to the main building, one side yard shall have a width <strong>of</strong> not less than<br />

eleven (11) feet.<br />

2.23 The keeping <strong>of</strong> livestock in a residential subdivision is allowed only on lots <strong>of</strong> fifteen thousand<br />

(15,000) square feet or larger with at least six thousand (6,000) square feet <strong>of</strong> lot area for each<br />

animal. No livestock shall be corralled or stabled within seventy-five (75) feet <strong>of</strong> the residence<br />

<strong>of</strong> any person other than the owner nor shall such confinement facilities be located in the front<br />

or side yard. Grazing <strong>of</strong> livestock shall be limited to the<br />

side and rear yards.<br />

2.3 <strong>Development</strong> siting dimensions.<br />

2.31 Projections into required yards:<br />

A. A paved terrace shall not be considered in the determination <strong>of</strong> yard sizes or lot coverage,<br />

provided, however, that such terrace is unro<strong>of</strong>ed and without walls, parapets, or other forms<br />

<strong>of</strong> enclosure. Such terrace, however, may have an open guard railing not over three (3) feet<br />

high and shall not project into any yard to a point closer<br />

than three (3) feet from any lot line.<br />
