Allégati<strong>on</strong>s c<strong>on</strong>cernant des actes de torture et mauvais traitements. Sel<strong>on</strong> les<br />
informati<strong>on</strong>s reçues, M. Ali Aarrass, âgé de 50 ans, citoyen belgo-marocain,<br />
a été extradé d‘Espagne vers le Maroc le 14 décembre 2010 pour des<br />
accusati<strong>on</strong>s liées au terrorisme. À s<strong>on</strong> arrivée au Maroc, il aurait été torturé<br />
pendant 10 jours et soumis à des formes de traitement cruel, inhumain et<br />
dégradant. Il est aussi rapporté qu‘il a avoué les accusati<strong>on</strong>s portées c<strong>on</strong>tre<br />
lui en signant une c<strong>on</strong>fessi<strong>on</strong> écrite. Néanmoins, il est rapporté qu‘en 8<br />
février 2011, il a dit au juge d‘instructi<strong>on</strong> que ses aveux avaient été obtenus<br />
sous la c<strong>on</strong>trainte. Le 29 novembre 2011, le tribunal marocain de première<br />
instance de Salé l‘a c<strong>on</strong>damné à 15 ans de pris<strong>on</strong>. Il est allégué que le<br />
tribunal a omis de mener une enquête adéquate sur les allégati<strong>on</strong>s d‘actes de<br />
torture commis. Il est rapporté que le 2 octobre 2012, la Cour d‘appel de<br />
Rabat-Salé a c<strong>on</strong>firmé sa c<strong>on</strong>damnati<strong>on</strong> en réduisant sa peine de 15 à 12<br />
ans.<br />
Alleged violati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> right to freedom <str<strong>on</strong>g>of</str<strong>on</strong>g> opini<strong>on</strong> and expressi<strong>on</strong>, right to<br />
freedom <str<strong>on</strong>g>of</str<strong>on</strong>g> peaceful assembly and to freedom <str<strong>on</strong>g>of</str<strong>on</strong>g> associati<strong>on</strong> due to <str<strong>on</strong>g>the</str<strong>on</strong>g><br />
adopti<strong>on</strong> <strong>on</strong> 12 November 2012 <str<strong>on</strong>g>of</str<strong>on</strong>g> Federal Legal Decree No. 5/2012,<br />
amending <str<strong>on</strong>g>the</str<strong>on</strong>g> 2006 Cybercrime Law. According to <str<strong>on</strong>g>the</str<strong>on</strong>g> informati<strong>on</strong><br />
received, certain clauses would threaten internet users with impris<strong>on</strong>ment<br />
and heavy fines for acts such as posting <strong>on</strong>line c<strong>on</strong>tent critical <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g><br />
Government or calling for peaceful dem<strong>on</strong>strati<strong>on</strong>s. Article 30 provides a<br />
sentence <str<strong>on</strong>g>of</str<strong>on</strong>g> up to life in pris<strong>on</strong> for using such means ―to advocate <str<strong>on</strong>g>the</str<strong>on</strong>g><br />
overthrow, change or usurpati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> system <str<strong>on</strong>g>of</str<strong>on</strong>g> governance in <str<strong>on</strong>g>the</str<strong>on</strong>g> state or<br />
obstruct provisi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> c<strong>on</strong>stituti<strong>on</strong> or existing law, or oppose <str<strong>on</strong>g>the</str<strong>on</strong>g><br />
fundamental principles <strong>on</strong> which <str<strong>on</strong>g>the</str<strong>on</strong>g> system <str<strong>on</strong>g>of</str<strong>on</strong>g> governance is based‖.<br />
Article 38 provides pris<strong>on</strong> terms for any<strong>on</strong>e using informati<strong>on</strong> technology<br />
who ―provides to any organizati<strong>on</strong>s, instituti<strong>on</strong>s, agencies or any o<str<strong>on</strong>g>the</str<strong>on</strong>g>r<br />
entities incorrect, inaccurate or misleading informati<strong>on</strong> liable to harm state<br />
interests or damage its reputati<strong>on</strong>, stature or status‖.<br />
