According to <str<strong>on</strong>g>the</str<strong>on</strong>g> informati<strong>on</strong> received, more than 1,400 residents <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

Lake St. Martin First Nati<strong>on</strong>, an Anishinabe indigenous community, were<br />

evacuated from <str<strong>on</strong>g>the</str<strong>on</strong>g>ir reserve in May 2011 by <str<strong>on</strong>g>the</str<strong>on</strong>g> province <str<strong>on</strong>g>of</str<strong>on</strong>g> Manitoba in<br />

order to divert flood waters that were headed to <str<strong>on</strong>g>the</str<strong>on</strong>g> city <str<strong>on</strong>g>of</str<strong>on</strong>g> Winnipeg. The<br />

flood waters were diverted into several indigenous communities including<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> Lake St. Martin reserve. The homes in <str<strong>on</strong>g>the</str<strong>on</strong>g> Lake St. Martin reserve were<br />

destroyed by <str<strong>on</strong>g>the</str<strong>on</strong>g> flood waters and are currently uninhabitable. The Lake St.<br />

Martin First Nati<strong>on</strong> leadership has attempted to negotiate with <str<strong>on</strong>g>the</str<strong>on</strong>g> province<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> Manitoba to have <str<strong>on</strong>g>the</str<strong>on</strong>g>ir permanent homes be in ―Site 9‖, a locati<strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g>y<br />

prefer for its locati<strong>on</strong> and potential for ec<strong>on</strong>omic development initiatives.<br />

However it is alleged that nei<str<strong>on</strong>g>the</str<strong>on</strong>g>r <str<strong>on</strong>g>the</str<strong>on</strong>g> provincial government nor <str<strong>on</strong>g>the</str<strong>on</strong>g> federal<br />

government have adequately c<strong>on</strong>sidered <str<strong>on</strong>g>the</str<strong>on</strong>g> community‘s requests with<br />

respect to Site 9 being <str<strong>on</strong>g>the</str<strong>on</strong>g> locati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g>ir new permanent reserve.<br />

Allegati<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> two draft laws <strong>on</strong> associati<strong>on</strong>s and <strong>on</strong> assembly which, if<br />

passed, would severely restrict <str<strong>on</strong>g>the</str<strong>on</strong>g> right to freedom <str<strong>on</strong>g>of</str<strong>on</strong>g> associati<strong>on</strong> and <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

peaceful assembly. According to <str<strong>on</strong>g>the</str<strong>on</strong>g> informati<strong>on</strong> received, two draft laws <strong>on</strong><br />

associati<strong>on</strong>s and <strong>on</strong> dem<strong>on</strong>strati<strong>on</strong>s in public places have been finalized in<br />

late January 2013. It is reported that several provisi<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g>se two draft<br />

laws would, if passed without fur<str<strong>on</strong>g>the</str<strong>on</strong>g>r changes, unduly and severely interfere<br />

with individuals‘ right to freedom <str<strong>on</strong>g>of</str<strong>on</strong>g> associati<strong>on</strong> and <str<strong>on</strong>g>of</str<strong>on</strong>g> peaceful assembly.<br />
