2012, la chambre d‘accusati<strong>on</strong> de la cour d‘appel de Tunis a mis M. Sami<br />

Fehri en examen pour de supposées malversati<strong>on</strong>s. M. Fehri a par la suite<br />

été inculpé pour détournement de f<strong>on</strong>ds publics. Il serait détenu depuis le 28<br />

août 2012 à la pris<strong>on</strong> de Mornaguia, près de Tunis. Le 28 novembre 2012, la<br />

cour de cassati<strong>on</strong>, la plus haute juridicti<strong>on</strong> de Tunisie, a émis une décisi<strong>on</strong><br />

ord<strong>on</strong>nant de casser la mise en examen de M. Fehri et de renvoyer l‘affaire<br />

devant la chambre d‘accusati<strong>on</strong>. Les autorités pénitentiaires ayant refusé de<br />

libérer M. Fehri, ses avocats <strong>on</strong>t demandé à la cour de cassati<strong>on</strong> de clarifier<br />

sa décisi<strong>on</strong>. Le 5 décembre 2012, la cour de cassati<strong>on</strong> a émis une décisi<strong>on</strong><br />

précisant que le mandat d‘arrêt faisait bien partie de la décisi<strong>on</strong> cassée par la<br />

cour. Malgré les décisi<strong>on</strong>s de la cour de cassati<strong>on</strong>, M. Fehri se trouverait<br />

toujours en détenti<strong>on</strong> à la pris<strong>on</strong> de Mornaguia.<br />

Alleged hunger strike carried out by <str<strong>on</strong>g>the</str<strong>on</strong>g> Chief <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Attawapiskat First<br />

Nati<strong>on</strong> in protest <str<strong>on</strong>g>of</str<strong>on</strong>g> recent legislative developments as well as <str<strong>on</strong>g>the</str<strong>on</strong>g> social and<br />

ec<strong>on</strong>omic c<strong>on</strong>diti<strong>on</strong>s affecting indigenous peoples in Canada. According to<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> informati<strong>on</strong> received, Chief Theresa Spence <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Attawapiskat First<br />

Nati<strong>on</strong> initiated a hunger strike <strong>on</strong> 11 December 2012 in Parliament Hill in<br />

Ottawa in order to protest recent legislative acti<strong>on</strong>s alleged to negatively<br />

impact indigenous peoples, alleged violati<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> treaty rights, and <strong>on</strong>going<br />

critical social and ec<strong>on</strong>omic c<strong>on</strong>diti<strong>on</strong>s in Attawapiskat and o<str<strong>on</strong>g>the</str<strong>on</strong>g>r aboriginal<br />

communities in Canada. Various dem<strong>on</strong>strati<strong>on</strong>s by indigenous peoples in<br />

Ottawa and o<str<strong>on</strong>g>the</str<strong>on</strong>g>r parts <str<strong>on</strong>g>of</str<strong>on</strong>g> Canada have also been carried out. The hunger<br />

strike and protests have been prompted in part by a federal omnibus budget<br />

implementati<strong>on</strong> bill introduced by <str<strong>on</strong>g>the</str<strong>on</strong>g> Prime Minister, <str<strong>on</strong>g>the</str<strong>on</strong>g> ―Jobs and Growth<br />

Act, 2012‖ (Bill C-45), which was recently passed by <str<strong>on</strong>g>the</str<strong>on</strong>g> Canadian<br />

parliament in December 2012. The Attawapiskat First Nati<strong>on</strong> was <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

subject <str<strong>on</strong>g>of</str<strong>on</strong>g> earlier communicati<strong>on</strong>s (see A/<str<strong>on</strong>g>HRC</str<strong>on</strong>g>/20/30, case no CAN 3/ 2011<br />

and A/<str<strong>on</strong>g>HRC</str<strong>on</strong>g>/21/49, case no CAN 2/2012).<br />
