without judicial process. According to <str<strong>on</strong>g>the</str<strong>on</strong>g> informati<strong>on</strong> received, at 10:15<br />
a.m. <strong>on</strong> 24 January 2013, six security agents appeared at <str<strong>on</strong>g>the</str<strong>on</strong>g> workplace <str<strong>on</strong>g>of</str<strong>on</strong>g><br />
Mr. Le Anh Hung in Hung Yen, forced him into a car and took him to an<br />
unknown locati<strong>on</strong>. Later he was found to be interned in Social Support<br />
Centre No. 2 in Ung Hoa, Hanoi, a mental health instituti<strong>on</strong>, but his friends<br />
and family were prevented from seeing him. It is reported that Mr. Le Anh<br />
Hung may be detained in Support Centre No. 2 under Ordinance 44 <str<strong>on</strong>g>of</str<strong>on</strong>g> 2002<br />
<strong>on</strong> Handling <str<strong>on</strong>g>of</str<strong>on</strong>g> Administrative Violati<strong>on</strong>s, which allows for <str<strong>on</strong>g>the</str<strong>on</strong>g> detenti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g><br />
individuals without trial for up to two years under house arrest<br />
(‗probati<strong>on</strong>ary detenti<strong>on</strong>‘); in ‗reformatories‘; educati<strong>on</strong>al instituti<strong>on</strong>s;<br />
rehabilitati<strong>on</strong> centres or ‗medical treatment establishments‘, including<br />
psychiatric wards. The provisi<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Ordinance relate to those who<br />
‗commit acts <str<strong>on</strong>g>of</str<strong>on</strong>g> violating legislati<strong>on</strong> <strong>on</strong> security, public order and safety, but<br />
not to <str<strong>on</strong>g>the</str<strong>on</strong>g> extent <str<strong>on</strong>g>of</str<strong>on</strong>g> penal liability‘ (Art 1.3 <str<strong>on</strong>g>of</str<strong>on</strong>g> Ordinance 44).<br />
Alleged sentence to death after a trial c<strong>on</strong>ducted in absentia and which did<br />
not provide for all <str<strong>on</strong>g>the</str<strong>on</strong>g> guarantees <str<strong>on</strong>g>of</str<strong>on</strong>g> a fair trial and due process, and alleged<br />
sentence to life impris<strong>on</strong>ment after a trial which did not provide for all <str<strong>on</strong>g>the</str<strong>on</strong>g><br />
guarantees <str<strong>on</strong>g>of</str<strong>on</strong>g> a fair trial and due process. According to <str<strong>on</strong>g>the</str<strong>on</strong>g> informati<strong>on</strong><br />
received, <strong>on</strong> 21 January 2013, Mr. Abdul Kalam Azad was sentenced to<br />
death by <str<strong>on</strong>g>the</str<strong>on</strong>g> Bangladesh Internati<strong>on</strong>al Crimes Tribunal. His trial was<br />
c<strong>on</strong>ducted in absentia and <str<strong>on</strong>g>the</str<strong>on</strong>g> State-appointed defence lawyer was<br />
reportedly inadequate. It is also alleged that political pressure was exercised<br />
<strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> Tribunal to accelerate <str<strong>on</strong>g>the</str<strong>on</strong>g> case <str<strong>on</strong>g>of</str<strong>on</strong>g> Mr. Azad and make it <str<strong>on</strong>g>the</str<strong>on</strong>g> first<br />
verdict <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Tribunal, even though Mr. Azad had been <strong>on</strong>e <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> latest<br />
accused to be indicted and his case was less advanced than that <str<strong>on</strong>g>of</str<strong>on</strong>g> many <str<strong>on</strong>g>of</str<strong>on</strong>g><br />
<str<strong>on</strong>g>the</str<strong>on</strong>g> o<str<strong>on</strong>g>the</str<strong>on</strong>g>r accused. Fur<str<strong>on</strong>g>the</str<strong>on</strong>g>rmore, <strong>on</strong> 5 February 2013 <str<strong>on</strong>g>the</str<strong>on</strong>g> Tribunal reportedly<br />
passed a sentence <str<strong>on</strong>g>of</str<strong>on</strong>g> life impris<strong>on</strong>ment against Mr. Abdul Kader Molla. Mr.<br />
Molla was <str<strong>on</strong>g>the</str<strong>on</strong>g> subject <str<strong>on</strong>g>of</str<strong>on</strong>g> previous communicati<strong>on</strong>s (see A/<str<strong>on</strong>g>HRC</str<strong>on</strong>g>/22/67, case<br />
