informati<strong>on</strong> received, Mr. Bialatski, President <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>Human</strong> <strong>Rights</strong> Centre (<str<strong>on</strong>g>HRC</str<strong>on</strong>g>)<br />
―Viasna‖ and Vice-President <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Internati<strong>on</strong>al Federati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>Human</strong> <strong>Rights</strong><br />
(FIDH), was arrested in Minsk‘s city centre by police representatives <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g><br />
Department <str<strong>on</strong>g>of</str<strong>on</strong>g> Financial Investigati<strong>on</strong>s. A search was c<strong>on</strong>ducted at his home by<br />
police <str<strong>on</strong>g>of</str<strong>on</strong>g>ficers <strong>on</strong> 4 August 2011. On 5 August 2011, Mr. Bialatski was allegedly<br />
transferred from a cell at <str<strong>on</strong>g>the</str<strong>on</strong>g> Financial Investigati<strong>on</strong> Department <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> State<br />
C<strong>on</strong>trol Committee to <str<strong>on</strong>g>the</str<strong>on</strong>g> detenti<strong>on</strong> centre <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Ministry <str<strong>on</strong>g>of</str<strong>on</strong>g> Interior.<br />
Mr. Bialatski was allegedly detained for having failed to declare <str<strong>on</strong>g>the</str<strong>on</strong>g> existence <str<strong>on</strong>g>of</str<strong>on</strong>g> a<br />
private foreign account registered <strong>on</strong> his name. As a result, a tax evasi<strong>on</strong> case was<br />
allegedly opened against Mr. Bialatski According to <str<strong>on</strong>g>the</str<strong>on</strong>g> informati<strong>on</strong> received, <str<strong>on</strong>g>the</str<strong>on</strong>g><br />
purpose <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> foreign account was to receive d<strong>on</strong>ati<strong>on</strong>s registered <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> name <str<strong>on</strong>g>of</str<strong>on</strong>g><br />
Mr. Bialatski, to finance ―Viasna‘s‖ human rights activities. Mr. Ales Bialatski and<br />
<str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>HRC</str<strong>on</strong>g> ―Viasna‖ have been <str<strong>on</strong>g>the</str<strong>on</strong>g> subject <str<strong>on</strong>g>of</str<strong>on</strong>g> previous communicati<strong>on</strong>s <strong>on</strong> 14 May<br />
2009, 24 August 2009, 22 December 2010 and 1 June 2011. An urgent appeal<br />
c<strong>on</strong>cerning Mr. Bialatski and <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>HRC</str<strong>on</strong>g> ―Viasna‖ was also sent <strong>on</strong> 25 February<br />
2011, see case no. BLR 2/2011, A/<str<strong>on</strong>g>HRC</str<strong>on</strong>g>/18/<str<strong>on</strong>g>51</str<strong>on</strong>g>.<br />
Alegación de que la Fiscalía ha solicitado que se extienda la medida de privación<br />
preventiva de libertad dictada c<strong>on</strong>tra la Jueza. Según las informaci<strong>on</strong>es recibidas,<br />
el 29 de noviembre de 2011, la Fiscalía habría solicitado al Tribunal 26º de Juicio<br />
de Caracas que se extienda por dos años la medida de privación preventiva de<br />
libertad dictada c<strong>on</strong>tra la Jueza María Lourdes Afiuni Mora, privada de libertad<br />
desde el 10 de diciembre de 2009. La fiscal encargada del caso habría presentado<br />
la petición debido a que el artículo 244 del Código Orgánico Procesal Penal<br />
establece que una pers<strong>on</strong>a no puede estar detenida por más de dos años si no le ha<br />
sido dictada sentencia c<strong>on</strong>denatoria, a menos que el Ministerio Público pida una<br />
prórroga cuando existan causas graves que lo justifiquen. Esta solicitud de la<br />
Fiscalía se debería ent<strong>on</strong>ces al hecho que la jueza Afiuni habría debido salir libre<br />
el 10 de diciembre de 2011 al cumplirse 2 años de su prisión preventiva sin<br />
c<strong>on</strong>dena.<br />
