According to <strong>the</strong> information received, on 7 December 2012, <strong>the</strong> Ministry <strong>of</strong> Foreign Affairs decided to expel Ms. Anne-Sophie Gindroz, Country Director <strong>of</strong> Helvetas Swiss Intercooperation, following a letter she sent on 21 November 2012 to development partners, prior to <strong>the</strong> 2012 Round Table Implementation Meeting, in which she deplored <strong>the</strong> lack <strong>of</strong> respect for <strong>the</strong> rights to freedom <strong>of</strong> expression, association, and peaceful assembly in <strong>the</strong> Lao PDR, and called on development partners to bear in mind <strong>the</strong> human rights situation in <strong>the</strong> country in <strong>the</strong> 2012 RTIM‘s framework. According to <strong>the</strong> information received, on 15 December 2012, Mr. Sombath Somphone was taken to a police station by two men in civilian clothing. His whereabouts remain unknown at <strong>the</strong> time <strong>of</strong> writing <strong>the</strong> present appeal. Prior to his disappearance, Mr. Somphone was involved in trying to stop threats made by <strong>of</strong>ficials against people who publicly spoke up against land grabbing <strong>the</strong>y experienced, during <strong>the</strong> Asia-Europe People‘s Forum held in November 2012. Mr. Somphone was calling for an investigation into <strong>the</strong>se threats. 03/01/2013 25/03/2013 20/12/2012 JUA USA 34/2012 United States <strong>of</strong> America Arbitrary detention; Freedom <strong>of</strong> expression; Freedom <strong>of</strong> religion; Alleged possible trial <strong>of</strong> a conscientious objector. According to <strong>the</strong> information received, Ms. Kimberly Rivera left <strong>the</strong> army without authorization while on leave from deployment to Iraq in early 2007. Ms. Rivera went to Canada after she made a decision that she could no longer participate in <strong>the</strong> war in Iraq or any o<strong>the</strong>r conflict for moral reasons. When she was in Canada, Ms. Rivera spoke out publicly about her objection to <strong>the</strong> conflict in Iraq. It has been reported that Ms. Rivera has been detained by <strong>the</strong> US military authorities since 20 September 2012 and may be tried before a court martial. If convicted, Ms. Rivera could face up to five years <strong>of</strong> imprisonment. 08/04/2013

According to <strong>the</strong> information received, several associations defending minority rights have been prevented registration. Different cases have been brought to <strong>the</strong> attention <strong>of</strong> <strong>the</strong> European Court <strong>of</strong> Human Rights, which concluded that Article 11 <strong>of</strong> <strong>the</strong> Convention related to <strong>the</strong> right to freedom <strong>of</strong> association had been violated. Despite <strong>the</strong> ruling <strong>of</strong> <strong>the</strong> European Court, <strong>the</strong> concerned associations allegedly continue to face obstacles to registration. Alleged religious intolerance, arbitrary detention, summary execution, torture and unfair trial proceedings. According to <strong>the</strong> information received, on 19 January 2007, individuals from <strong>the</strong> Followers <strong>of</strong> Imam Ahmed El Hassan El Yamani (al-Mahdi) group were attacked in <strong>the</strong> city <strong>of</strong> Najaf, <strong>the</strong>ir schools burned down and <strong>the</strong>ir books confiscated or burnt. On 18 January 2008, a Shi‘a sanctuary along with o<strong>the</strong>r residences and mosques was attacked by army and police forces in <strong>the</strong> cities <strong>of</strong> Basra and Nassiriya, which reportedly resulted in <strong>the</strong> summary executions <strong>of</strong> at least 18 unarmed members <strong>of</strong> <strong>the</strong> Followers <strong>of</strong> Imam Ahmed El Hassan El Yamani and 378 arrests. Detainees were purportedly subjected to torture and ill-treatment and detained for extended periods waiting for <strong>the</strong>ir trials. All but 45 <strong>of</strong> <strong>the</strong> detainees were eventually released. On 26 February 2009, <strong>the</strong> Appeal Criminal Court <strong>of</strong> Zi Kar Governorate convicted 28 <strong>of</strong> <strong>the</strong> accused to death sentences (pending imminent execution), including Najah Taleb Salman, Ghanem Archij Salem, Rahim Bashi Awad, Sabah Nuri Dagher, Mahmoud Razzak Mohamed, Ali Attia Rahima, Haider Kadhem Doeij, Hussein Sharif Mazuk, Abdullah Naim Delli, Mohamed Sharif Mazuk, Mohamed Jawad Hussein, Aqeel Kassem Mohamed, Hassan Charif Marzuk, Hussein Abd El Zahra Ouda, Mohamed Ali Hattab, Dia‘ Azib Lahoud, Akil Jassem Mohamed, Azhar Thajil Edham, Fadel Mohamed Cha‘in, Ali Dakhil Salem, Ala‘ Khalaf Abed Ali, Haidar Youssef Aziz, Thaeir Hattab Ati, Mohamed Abed Al Amir Jaafar, Kazem Wahid Hussein, Ahmed Hachem Jaber, Hussein Archik Salem and Ghassan Monzer Mahouss, and 16 to life imprisonment. 04/03/2013 A/<strong>HRC</strong>/<strong>23</strong>/<strong>51</strong> 29
