20 Date Type 12/12/2012 AL Case No Country Mandate(s) Summary <strong>of</strong> <strong>the</strong> allegation transmitted Reply EGY 17/2012 Egypt Discrimination against women in law and in practice; Concerns expressed in relation to <strong>the</strong> final draft <strong>of</strong> <strong>the</strong> new Constitution as approved by <strong>the</strong> Constituent Assembly on 30 November 2012 and in particular in relation to provisions on equality, non-discrimination and protection and promotion <strong>of</strong> women‘s human rights in <strong>the</strong> adopted text. According to <strong>the</strong> information received, only 1 woman participated in <strong>the</strong> Assembly‘s final deliberations on and approval <strong>of</strong> <strong>the</strong> draft Constitution. The adopted text would be submitted on 15 December 2012 for approval by <strong>the</strong> people <strong>of</strong> Egypt through a national referendum. A/<strong>HRC</strong>/<strong>23</strong>/<strong>51</strong> 12/12/2012 AL PHL 6/2012 Philippines Extreme poverty; Alleged evictions and confiscation <strong>of</strong> property <strong>of</strong> more than 350 vendors from Rizal Park (commonly known as Luneta Park) in Manila. According to information received, vendors have been selling food and refreshments for many years inside Luneta Park. Reportedly, a zero-vending policy was adopted by <strong>the</strong> National Parks Development Committee in 2010. Subsequently, on several occasions, during February, March, April and June 2012, dozens <strong>of</strong> vendors have been evicted from <strong>the</strong> Park and <strong>the</strong>ir merchandise confiscated. 12/12/2012 JAL RUS 8/2012 Russian Federation Freedom <strong>of</strong> expression; Health; Human rights defenders; Alleged impending first reading <strong>of</strong> <strong>the</strong> draft federal law No. 44554-6 introducing amendments to <strong>the</strong> Code <strong>of</strong> <strong>the</strong> Russian Federation on Administrative Offences regarding <strong>the</strong> ―propaganda <strong>of</strong> homosexuality‖. According to <strong>the</strong> information received, on 19 December 2012, <strong>the</strong> Russian State Duma was scheduled to consider in first reading a draft law banning <strong>the</strong> ―propaganda <strong>of</strong> homosexuality‖ at federal level across <strong>the</strong> country. The amendment contained in Art. 6.13.1. to <strong>the</strong> Code <strong>of</strong> <strong>the</strong> Russian Federation on Administrative Offences would make <strong>the</strong> ―propaganda <strong>of</strong> homosexuality among minors‖ punishable by administrative fine. The amount <strong>of</strong> <strong>the</strong> fine foreseen is 4,000-5,000 roubles ($130 – 160) for citizens; 40,000-50,000 ($1,300-1,600) roubles for <strong>of</strong>ficials and 400,000-500,000 roubles ($13,000 – 16,000) for legal entities. 24/01/2013

According to <strong>the</strong> information received, <strong>the</strong> detention <strong>of</strong> Mr. Abdul Wahid Rezaee, an Afghani national, is based on allegation <strong>of</strong> ‗people smuggling‘, but <strong>the</strong> authorities had not yet interviewed him nor brought his case to a court. Meanwhile his health conditions were deteriorating and he repeatedly threatened to harm himself or o<strong>the</strong>rs. No administrative measures to ease his situation had been taken (community detention). 13/12/2012 JUA MMR 12/2012 Myanmar Freedom <strong>of</strong> expression; Freedom <strong>of</strong> peaceful assembly and <strong>of</strong> association; Human rights defenders; Myanmar; Torture; Alleged re-arrest and detention <strong>of</strong> former prisoner <strong>of</strong> conscience. According to <strong>the</strong> information received, Ashin Gambira (aka) Nyi Nyi Lwin, 33 years old, was arrested on 1 December 2012 and remanded in custody in Insein Prison before being freed on bail on 10 December by a court in Thanlyin for health reasons. He was told that police stations from three townships, Thingangyun, Bahan and Thanlyin, had filed cases against him under sections 448, 427 and 454 <strong>of</strong> <strong>the</strong> Myanmar Penal Code, which cover crimes relating to trespassing and ―damaging <strong>the</strong> dignity <strong>of</strong> <strong>the</strong> nation‖. Allegedly Gambira was detained to prevent him from participating in a campaign to support <strong>the</strong> alleged victims <strong>of</strong> a police crackdown on protesters against <strong>the</strong> Mt. Letpadaung copper mine in northwestern Myanmar. Mr. Gambira has reportedly been arrested three times since he was released in <strong>the</strong> January 2012 amnesty. Mr. Gambira was <strong>the</strong> subject <strong>of</strong> an earlier communication (see A/<strong>HRC</strong>/19/44, case no MMR 4/2011). 21 13/12/2012 AL NGA 5/2012 Nigeria Summary executions; Alleged extrajudicial killings by <strong>the</strong> Nigerian Security Forces. According to <strong>the</strong> information received, Boko Haram, a group operating in nor<strong>the</strong>rn Nigeria, has launched scaled terror attacks across Nigeria. Reportedly, since mid-2009, as a tactic <strong>of</strong> response to fight this group, extrajudicial executions, enforced disappearance, torture and detention without trial against persons known to be members <strong>of</strong> this group and those suspected to be helping or sympathizing with <strong>the</strong>m have been performed by <strong>the</strong> Nigerian Security forces. Moreover, it is alleged that incidents unrelated to <strong>the</strong> fight against Boko Haram have also occurred, including killings by police <strong>of</strong>ficers <strong>of</strong> Umoar Danmichika and Lucy Ukpong. 21/12/2012 A/<strong>HRC</strong>/<strong>23</strong>/<strong>51</strong>
