Statement of Warranty<br />

Warranty Coverage<br />

Proxim Wireless Corporation warrants that its Products are manufactured solely from new parts, conform substantially to<br />

specifications, <strong>and</strong> will be free of defects in material <strong>and</strong> workmanship for a Warranty Period of 1 year from the date of<br />

purchase.<br />

Repair or Replacement<br />

In the event a Product fails to perform in accordance with its specification during the Warranty Period, Proxim offers<br />

return-to-factory repair or replacement, with a thirty (30) business-day turnaround from the date of receipt of the<br />

defective Product at a Proxim Wireless Corporation Repair Center. When Proxim Wireless has reasonably determined<br />

that a returned Product is defective <strong>and</strong> is still under Warranty, Proxim Wireless shall, at its option, either: (a) repair the<br />

defective Product; (b) replace the defective Product with a refurbished Product that is equivalent to the original; or (c)<br />

where repair or replacement cannot be accomplished, refund the price paid for the defective Product. The Warranty<br />

Period for repaired or replacement Products shall be ninety (90) days or the remainder of the original Warranty Period,<br />

whichever is longer. This constitutes Buyer’s sole <strong>and</strong> exclusive remedy <strong>and</strong> Proxim Wireless’s sole <strong>and</strong> exclusive<br />

liability under this Warranty.<br />

Limitations of Warranty<br />

The express warranties set forth in this Agreement will not apply to defects in a Product caused; (i) through no fault of<br />

Proxim Wireless during shipment to or from Buyer, (ii) by the use of software other than that provided with or installed in<br />

the Product, (iii) by the use or operation of the Product in an application or environment other than that intended or<br />

recommended by Proxim Wireless, (iv) by modifications, alterations, or repairs made to the Product by any party other<br />

than Proxim Wireless or Proxim Wireless’s authorized repair partners, (v) by the Product being subjected to unusual<br />

physical or electrical stress, or (vii) by failure of Buyer to comply with any of the return procedures specified in this<br />

Statement of Warranty.<br />

Buyers should return defective Products within the first 30 days to the merchant from which the Products were<br />

purchased. Buyers can contact a Proxim Wireless Customer Service Center either by telephone or via web. Calls for<br />

support for Products that are near the end of their warranty period should be made not longer than seven (7) days after<br />

expiration of warranty. Support <strong>and</strong> repair of products that are out of warranty will be subject to a repair fee. Contact<br />
