6.5 MAINTENANCE AGREEMENTS AND <strong>BMP</strong>-RELATED LEGALDOCUMENTSInspection of a baffle vault to determine the depth of sediment accumulation and whetheroil/grease absorbent pads need replacement.The property owner is responsible for selection, installation, maintenance, andperformance of <strong>BMP</strong>s on their property. However, it is possible to enter intoan agreement with other adjacent property owner to collaborate on theinstallation and maintenance of <strong>BMP</strong>s. If such an agreement is formed, itshould state which parties are responsible for the maintenance activities andcosts associated with the <strong>BMP</strong>s. Types of agreements that are commonly usedin the Lake <strong>Tahoe</strong> Region include the following:• Home Owner/Property Owner Associations (HOAs/POAS): HOAs aretypically responsible for maintenance of all <strong>BMP</strong>s within common areas of aresidential development. Individual property owners may be assessed forcommon area maintenance costs.• Deed restrictions: In cases where <strong>BMP</strong>s are shared by multiple properties, adeed restriction may be placed on all affected properties to ensure <strong>BMP</strong>sremain in place. These restrictions remain with the property regardless ofchanges in ownership.• Limited Government Responsibility: The local government is responsiblefor all areas in the city’s or county’s right-of-way and any other publiclyowned land such as local facilities and parks.• Conditional use permits: In cases where the United States Forest Serviceallows private use of federal land, responsibility for <strong>BMP</strong>s inspection andmaintenance will be stated in the conditional use permit.• Stormwater Pollution Prevention Plan: A Stormwater Pollution PreventionPlan (SWPPP) is a maintenance agreement required for Commercial/TRPA <strong>BMP</strong> HandbookCHAPTER 6: Inspection, Maintenance, and Monitoring2012 Page 6-7
