Number Portability<br />

After discussions lasting longer than a year, a new decree on<br />

number portability entered into force on September 1, <strong>2009</strong>,<br />

shortening both the mobile and fi xed portability process to fi ve<br />

working days. Fixed portability was launched without a formal<br />

contract with Slovak <strong>Tele<strong>com</strong></strong> the same month, with a new<br />

wholesale price (€9.90 ex VAT down from €49.79 ex VAT) and<br />

some process details were agreed to later and effective as of<br />

February 1, 2010.<br />

Mobile Call Termination Rates<br />

In January 2010, TÚSR adopted a fi nal decision designating<br />

the three mobile network operators as having an SMP on<br />

their respective networks without imposing cost orientation.<br />

The price regulation is instead based on benchmarking<br />

methodology, using the last known ERG simple average of EU<br />

countries whic h implemented LRIC from July <strong>2009</strong>. For the next<br />

periods (February – January) the same methodology shall be<br />

applied until long-run incremental costing will be available (not<br />

before 2012). The 1.3 euro cent asymmetry shall be kept for<br />

O2 until the end of the fi rst year of regulation (February 2010 –<br />

January 2011).<br />

Spectrum<br />

■ TÚSR gathered information in December <strong>2009</strong> from the mobile<br />

operators on their needs in terms of spectrum, possibilities<br />

and expected timeframe with a view to implementing a<br />

900 MHz and 1800 MHz bands refarming in summer 2011.<br />

■ A new consultation has been announced for H1 2010 by<br />

the Ministry of Transport, Posts and <strong>Tele<strong>com</strong></strong>munications<br />

regarding the refarming of the 790-862 MHz bands (digital<br />

dividend).<br />

■ Frequency blocks in the 2.6 GHz band have been provisionally<br />

allocated to MMDS providers until December 2011. TÚSR<br />

announced their intention to shorten this allocation and reallocate<br />

the band in a public tender. <strong>Orange</strong> Slovensko does<br />

not support such re-allocation before 2011/2012 due to the<br />

lack until then of suffi cient mobile handsets and prefers any<br />

allocation to happen only after the digital dividend allocation<br />

will be known.<br />

Competition investigation: t he European<br />

Commission antitrust carried out an inspection at<br />

Slovak Telekom.<br />

Compliance: t he European Commission sent<br />

a reasoned opinion to Slovakia as the Slovak<br />

Competition Act does not allow the application<br />

of <strong>com</strong>petition law and sector-specifi c regulation<br />

in parallel.<br />

Wholesale unbundled market analysis<br />

(2 nd round ): TÚSR notifi ed the second cycle of<br />

its analysis on the wholesale unbundled access<br />

market to the European Commission.<br />

Universal Service: <strong>Orange</strong> Slovensko and fi ve<br />

alternative operators formally asked TÚSR to<br />

suspend administrative proceedings.<br />
