In April <strong>2009</strong>, UKE issued a second round consultation on the wholesale call termination on individual mobile networks market,<br />

proposing the following glide-path for the three operators PTK Centertel (<strong>Orange</strong>), Polkomtel and PTC:<br />

In September <strong>2009</strong>, UKE notifi ed to the European Commission<br />

a draft price control decision for the wholesale call termination<br />

market. UKE proposed to maintain MTRs at 0.1677 zloty on the<br />

three major mobile network operators PTK Centertel, Polkomtel<br />

and PTC as of January 1, 2010. The tariff was to be valid until the<br />

next approval of cost calculations submitted by the operators<br />

or – if the regulator rejected the operators’ proposal – until a<br />

new decision was issued by UKE. The European Commission<br />

wel<strong>com</strong>ed UKE’s proposal to set MTRs at a level that is<br />

already below the EU average. The European Commission<br />

found that the methodology chosen by UKE – rates based on<br />

costs incurred, and as verifi ed through <strong>com</strong>parison with other<br />

countries – did not promote effi ciency and as such should only<br />

be considered as a temporary measure.<br />

In October <strong>2009</strong>, UKE notifi ed to the European Commission<br />

the draft price control decision for P4 and proposed that P4’s<br />

mobile call termination rates should be gradually reduced in<br />

order to eliminate the asymmetry between P4 and the other<br />

mobile network operators by 2014.<br />

In March 2010, UKE announced that MTRs in mobile network<br />

operators’ networks will not decrease until January 1, 2011.<br />

SMS<br />

In October <strong>2009</strong>, UKE launched a consultation on the defi nition<br />

of the wholesale market for SMS termination in individual public<br />

mobile telephone networks with the objective to ex ante regulate<br />

these rates and services. Following this consultation, UKE could<br />

propose in 2010 ex ante obligations on the SMS / MMS market,<br />

as well as measures to reduce call termination rates.<br />

Spectrum<br />

2.6 GHz TDD license award<br />

In October <strong>2009</strong>, an exclusive license was awarded in the<br />

2570 - 2620 MHz range, for the provision of tele<strong>com</strong>munication<br />

services over broadband mobile access networks throughout<br />

Poland.<br />

Two offers were proposed by Aero 2 and Milmex Systemy<br />

Komputerowe. The Aero 2 offer was preferred by the tender<br />

Committee. The license enables the use of frequencies until<br />

December 31, 2024. Communications (transmission and<br />

reception) between the base station and a user’s terminal is<br />

in the same range of frequencies (TDD - Time Division Duplex<br />

mode).<br />

2.6 GHz FDD consultations<br />

On June 3, <strong>2009</strong> the UKE President announced public<br />

consultations on 7 licenses in the 2010 – 2025 MHz, 2500<br />

– 2570 MHz and 2620 – 2690 MHz bands, intended for the<br />

provision of tele<strong>com</strong>munication services in broadband wireless<br />

access networks throughout Poland in the mobile telephony<br />

service with an expiration date of December 31, 2024.<br />

License in the 3600 - 3800 MHz frequency band<br />

In October <strong>2009</strong>, a tender for a general exclusive frequency<br />

license covering four duplex radio channels, each of 3.5 MHz<br />

bandwidth in the 3600 – 3800 MHz range, was announced.<br />

The license shall be used for point-to-multipoint networks until<br />

December 31, 2022. The offers were to be submitted before<br />

30 November <strong>2009</strong>.<br />
