6) Student enters a plea for each charge (“in violation” or “not in violation”).<br />
7) The accused student remains in the room throughout the entire process while each witness provides testimony.<br />
8) Board members ask the witness questions, the accused student asks the witness questions and then the witness<br />
leaves the room (the witness must wait outside in case more testimony is needed).<br />
9) The accused student answers questions and makes a closing statement, then leaves the room.<br />
10) Board members deliberate directly after the hearing in order to render a decision. The judicial decision will be<br />
determined by majority vote (2 votes minimum).<br />
11) The Board renders the verbal decision to the student.<br />
12) The Director of Residence Life follows-up with a formal sanction letter within one work day.<br />
13) The accused student has the opportunity to appeal the Judicial Board decision by submitting a written appeal to the<br />
Vice President for Student Affairs within 24 hours of receipt of the sanctions letter. Students are only permitted to<br />
appeal based on improper judicial procedures or if new evidence has been discovered that is relevant to the case.<br />
Waiver<br />
If a student does not wish to go to a Judicial Board hearing, s/he may complete a Hearing Waiver with the Director<br />
of Residence Life. Through this process, the student would take full responsibility for all charges that were levied and<br />
would receive the standard sanctions.<br />
Violation Levels<br />
The following is a comprehensive, but not all-inclusive, list of Student Code of Conduct policy violations that will be<br />
handled by the Director of Residence Life. NOTE - <strong>Lake</strong> <strong>Erie</strong> <strong>College</strong> students will be adjudicated for any violations<br />
committed by their guests.<br />
Level 1<br />
1) 1-2 alcohol offenses<br />
2) Noise<br />
3) Unapproved guest/Visitation<br />
4) Minor vandalism (under $50)<br />
5) Bodily Harm<br />
6) Discourtesy to faculty/staff<br />
7) Disorderly Conduct<br />
8) Gambling<br />
9) Illegal entry<br />
10) Receipt and sale of stolen goods<br />
11) Traffic and vehicle regulations<br />
12) Harassment<br />
13) Fire safety - candles, incense, items hanging from sprinkler<br />
14) Unauthorized use of an alarmed door<br />
Level 1 appeal process – accused student has the opportunity to appeal by submitting a written appeal to the dean of<br />
students no later than 24 hours after receiving the judicial sanction letter. Students are only permitted to appeal based<br />
