The Act requires registered sex offenders to provide notice, as required under State law, to any higher education institution<br />
at which the person is a student, an employee or is present to carry on a vocation. State procedures are required<br />
to ensure that this registration information is promptly made available to law enforcement agencies with jurisdiction<br />
where institutions of higher education are located and that it is entered into appropriate State records or data system.<br />
A student at <strong>Lake</strong> <strong>Erie</strong> <strong>College</strong> found to be in noncompliance with this Act would be dismissed without refund.<br />
Smoking<br />
In accordance with Chapter 3794 of the revised code regarding Ohio’s smoking regulations and In keeping with <strong>Lake</strong> <strong>Erie</strong> <strong>College</strong>’s<br />
intent to provide a safe and healthful work environment, smoking in the work place is prohibited in <strong>College</strong>-owned buildings,<br />
building entrances, and <strong>College</strong>-owned vehicles and will be permitted only in specific, designated outside locations. A limited<br />
number of “Designated Smoking Areas” have been strategically located on campus. For a list of these places, please see page 60.<br />
Solicitation and/or Outside Vendors on Campus<br />
Any <strong>College</strong> or non-<strong>College</strong> individual, group or organization desiring to solicit students, faculty and/or staff to purchase<br />
goods or use services must obtain the written approval of the Chief Financial Officer or his/her designee.<br />
Any member of the <strong>College</strong> community being asked to contribute or purchase should ask for proof that the solicitor or<br />
vendor has official approval to conduct business on the campus. If proof cannot be provided, community members are<br />
instructed to immediately report this activity to Security, the Chief Financial Officer or the Student Life Office. Please<br />
be prepared to give a physical description of any individuals involved as well as their vehicles.<br />
Stalking<br />
<strong>Lake</strong> <strong>Erie</strong> <strong>College</strong>, in line with the Ohio Revised Code (2903.211 Menacing by Stalking), defines staking as:<br />
Engaging in a pattern of conduct shall knowingly cause another person to believe that the offender will cause physical<br />
harm or mental distress; further, a person, through the use of any electronic method of remotely transferring information<br />
with purpose to urge or incite another to commit a violation as defined; no person, with a sexual motivation.<br />
Pattern of conduct is defined as two or more actions or incidents closely related in time, whether or not there has been<br />
a prior conviction.<br />
Mental distress is defined as (a) any mental illness or condition that involves some temporary substantial incapacity;<br />
(b) any mental illness or condition that would normally require psychiatric treatment, psychological treatment, or<br />
other mental health services, whether or not any person requested or received psychiatric treatment, psychological<br />
treatment, or other mental health services.<br />
Examples of stalking and cyber stalking behaviors include, but are not limited to:<br />
• Repeated, non-consensual communications including in person communication, telephone calls, voice messages, text<br />
messages, email messages, social network site postings, instant messages, posting of pictures or personal information<br />
on website, written letters, gifts, or any other communications that are undesired and/or place another person in<br />
fear<br />
• Persistent physical approaches and/or request for dates, meetings, etc<br />
• Threats that create fear for one’s life or safety, or fear for the safety of one’s family, friends, roommates or others<br />
• Unwanted touching<br />
• Pursuing or following another person, repeatedly showing up or waiting outside a person’s home, classroom, place<br />
of employment or car<br />
• Using surveillance or other types of observation, either in person or through the use of electronic devices or software<br />
to track or obtain private information<br />
• Use of threatening gestures<br />
• Trespassing or breaking into a person’s care or residence<br />
• Vandalism and/or destruction of a person’s personal property<br />
Any student who believes he/she is being stalked should take the threats seriously and report it immediately to the<br />
Painesville Police, Campus Security and the Dean of Students. Anyone in immediate danger should call 911. Threats<br />
should always be taken seriously and reported to the Police and Campus Personnel. Evidence, such as emails, text<br />
messages, phone messages, notes, and letters should be kept and shared when reporting to authorities. This includes<br />
keeping a time line of contact etc.<br />
Any student of the <strong>College</strong> who has been found, after appropriate investigation, to have stalked another student is<br />
in violation of this policy and will be subject to disciplinary action up to and including expulsion. <strong>College</strong> disciplinary<br />
procedures are independent of any and all criminal procedures.<br />
