employee will be given ten (10) work days to request subsequent review by theappropriate Associate Deputy Director <strong>of</strong> that determination.(2) The Union and/or the employee will be given an opportunity to provide all evidence andstatements, as applicable, to the Associate Deputy Director either in person, by mail, orboth. The associate Deputy Director will review the determination and sustain thatdecision or overturn it. The employee and/or the Union will be notified <strong>of</strong> that decisionwithin fifteen (15) work days <strong>of</strong> the meeting, if requested, or receipt <strong>of</strong> the information ifa meeting was not requested. Failure to render a decision within that timeframe will notoverturn the prior determination.Section 5. Temporary PositionContract education employees will be moved to the pay level <strong>of</strong> temporary position within ten (10) workdays <strong>of</strong> assuming the duties <strong>of</strong> the position, if it is a higher-level position, and the employee is qualifiedas determined by Management (post audited by Human Resources). The pay will be retroactive to thefirst day <strong>of</strong> the position.Section 6. Vacation/Personal LeaveThe use <strong>of</strong> earned leave and compensatory time shall be considered a right, rather than a privilege,subject to work restrictions and management approval. Leave will be pre-credited to employees who areto be employed more than twenty-four (24) weeks. Following are the types <strong>of</strong> leave available to <strong>contract</strong>education employees.A. Vacation Leave. Year-long employees earn and are granted vacation leave in accordance with 25CFR 38 and 62 BIAM 11.62(D).B. School Vacation Leave. Contingent upon the school calendar, school-term employees mayreceive up to 136 hours (17 days) <strong>of</strong> school vacation. Approval for use <strong>of</strong> this leave will beadministratively determined by management and shall be scheduled when school is not insession. Should work requirements demand that an employee is required to work during schoolvacation time, compensation shall be received at the base rate <strong>of</strong> pay or the employee maychoose equivalent time <strong>of</strong>f.NOTE: Teachers, Home living Specialists and Counselors are not eligible for school vacation leave.C. Personal Leave. Personal leave applies only to School Term employees. Full-time employeeswith appointments receive forty-eight (48) hours <strong>of</strong> pre-credit personal leave. Full timeemployees hired with appointments <strong>of</strong> less than twenty-four (24) weeks will receive twentyfour(24) hours <strong>of</strong> pre-credit personal leave. Personal leave will be granted at the employee’srequest subject to Management approval. This leave will not necessarily be limited to noninstructionaltime. Management will make every attempt to accommodate the employee’srequest. Reason for denials will be written. Personal leave which has not been used by the end<strong>of</strong> an employee’s <strong>contract</strong> period (end <strong>of</strong> school year <strong>contract</strong>) will be paid to the employee at101
