following conditions: 1) all available sick leave is used; 2) the employee will return to duty longenough to repay the sick leave; and 3) does not involve Family Friendly Leave authority. Thegranting <strong>of</strong> advance sick leave is subject to supervisory approval.(1) Repayment. Employees must repay any advanced sick leave unless: 1) the separation iscaused by death; 2) disability retirement occurs; or 3) a disability prevents the employeefrom returning to duty or continuing in the service based on medical evidence that theemploying <strong>of</strong>fice has determined acceptable.(2) Unused Sick Leave: Employees are not paid for unused sick leave upon separation.(3) Illness while on Annual Leave: An employee who becomes ill while on Annual Leavemay have the time <strong>of</strong> illness charged to sick leave provided the employee notifies thesupervisor on the first day <strong>of</strong> the illness.Section 4. Family Friendly Leave PoliciesThis applies to any employee who is covered by the Federal leave system [see 5 USC 6301(2)], and whootherwise meets the eligibility requirements described in 5 CFR 630.1201.A. Family and Medical Leave Act <strong>of</strong> 1993: Federal employees are entitled to a total <strong>of</strong> 12administrative workweeks <strong>of</strong> unpaid leave during any 12-month period for the:(1) birth <strong>of</strong> a child and care <strong>of</strong> a newborn;(2) adoption or foster care <strong>of</strong> a child;(3) care <strong>of</strong> a spouse, son, daughter, or parent with a serious health condition;(4) Serious health condition <strong>of</strong> the employee that makes the employee unable to performhis/her position. Upon return from such leave an employee must be returned to the sameposition or to an equivalent position with equivalent benefits, pay, status, and other termsand conditions <strong>of</strong> employment.a. Definition <strong>of</strong> Family Members:i. Spouse (includes common law marriage in States where it is recognized);ii. Son or Daughter is defined in terms <strong>of</strong> the child’s age and relationship tothe employee. Age: son or daughter who is either under eighteen (18)years <strong>of</strong> age, or 18 years <strong>of</strong> age or older and incapable <strong>of</strong> self-care due tomental/physical disabilities; Relationship: a biological, adopted, or fosterchild, stepchild, a legal ward, or a child <strong>of</strong> a person standing in locoparentis.60
