Employees are requested to schedule their military leave at times other thanwhen school is in session.B. Eligible Employees. School Year, Year Long Contract employees, Part-time (16-32 hours/week),and Temporary Indefinite Appointments. (Extensions <strong>of</strong> appointments exceeding one year do notqualify as meeting the one-year requirement; therefore, temporary employees are not eligible formilitary leave.)C. Military Leave will be granted in accordance with the provisions <strong>of</strong> 5 U.S.C. 5519 and 5 U.S.C.6323. Administrative Leave/Excused AbsenceAdministrative Leave may be granted when a school/activity shuts down due to circumstances beyondthe Agency’s control provided the employee is not already on scheduled leave. Administrative leave foremergency reasons shall not be approved for more than three (3) consecutive days per <strong>contract</strong> year.Such leave shall not reduce the minimum number <strong>of</strong> instructional days required by regulation, and whenadministrative leave has been approved, the instructional days may not be made up by lengthening theinstructional day. Normally such days are made up by instructing on days scheduled as school vacationdays or by adding extra days to the end <strong>of</strong> the school year for snow days.Section 13. Leave Without PayA. Leave without pay (LWOP) is a temporary non-pay status and absence from duty. Approval <strong>of</strong>LWOP will be granted if the manager deems the leave necessary based on the circumstances.This includes emergencies or other appropriate circumstances supporting the request other thanthose stated in “Approval Authority and Appropriate Uses.”B. Approval Authority and Appropriate Uses. Authorizing LWOP is a matter <strong>of</strong> administrativediscretion. LWOP requests will be examined in conjunction with the feasibility <strong>of</strong> granting otherleave types for each individual case, as well as granting LWOP on an extended basis whilewaiting on a retirement or OWCP claim, but not to exceed one year. An employee is not entitledto LWOP unless the following situations exist:(1) Disabled veterans in need <strong>of</strong> medical treatment;(2) Guard and Reserve personnel performing active duty military service;(3) Conditions meeting the Family & Medical Leave Act; or(4) In receipt <strong>of</strong> compensation for an injury/illness incurred on thejob.107
