Article 15Overtime/Compensatory TimeSection 1. Employee AssignmentsEmployees who are required by Management to work overtime will be compensated in accordance withapplicable laws and regulations.Section 2. DistributionRecords showing the overtime distribution for <strong>bargaining</strong> unit employees will be maintained and madeavailable to the Union upon request. Normally, the opportunity to perform overtime work will be madeavailable to all qualified employees as overtime work becomes necessary. Consistent with missionrequirements, first consideration in assignment <strong>of</strong> overtime will be given to employees currentlyperforming the work. Second consideration will be given to other qualified employees in the assignment<strong>of</strong> overtime/holiday work. Supervisors are responsible for making overtime assignments.Section 3. ExcusalAn employee, upon request, should be released from an overtime assignment if it is determined bymanagement that a qualified replacement is available and willing to work.Section 4. Callback PayCallback pay occurs when an employee is called back after having been dismissed for the day aftercompletion <strong>of</strong> the normal tour <strong>of</strong> duty. The employee will receive pay for at least two (2) hours induration for the purpose <strong>of</strong> premium pay, either in money or compensatory time <strong>of</strong>f at the employee’schoice. Overtime will be paid in fifteen (15) minute increments after the first two (2) hours.Section 5. Compensatory TimeA. Compensatory time <strong>of</strong>f is time <strong>of</strong>f with pay in lieu <strong>of</strong> overtime pay for irregular or occasionalovertime work, or under flexible work schedules, time <strong>of</strong>f with pay in lieu <strong>of</strong> overtime pay forregularly scheduled, or irregular or occasional overtime work. At the request <strong>of</strong> the followingtypes <strong>of</strong> employees, the agency may grant compensatory time <strong>of</strong>f from the employee’s tour <strong>of</strong>duty instead <strong>of</strong> overtime payment for an equal amount <strong>of</strong> overtime work:(1) Employees who are covered by the Fair Labor Standards Act (FLSA), i.e., employeesconsidered “Nonexempt” from the FLSA;(2) General Schedule (GS) employees who are “Exempt” (not covered) by the FLSA andearn less than the maximum pay <strong>of</strong> a GS-10; and(3) Federal wage system employees.55
