Article 31Education ActivitiesSection 1. Classroom ActivitiesA. Teachers shall be afforded the right to maintain discipline in accordance with the policies <strong>of</strong> thestudent handbook established at the school.B. Any person at the school or on its grounds whose behavior is a threat to the safety and/or health<strong>of</strong> others will be reported to the appropriate supervisor. Management will take whatever steps areavailable to protect students and staff.C. Each school is by statute required to have a code <strong>of</strong> student conduct. This code <strong>of</strong> conduct shouldbe developed by students’ administrators, the Union, staff, and the appropriate school board andin the interest <strong>of</strong> all concerned should be strictly enforced by appropriate <strong>of</strong>ficials. Thedeveloped code will conform to all applicable laws and regulations.D. Management will make every attempt to schedule administrative meetings before or after the end<strong>of</strong> the students’ instructional day.Section 2. School CalendarA. The appropriate school administrators will furnish the Union national <strong>of</strong>fice and the localsteward with the proposed school calendar for the next school year before submitting thecalendar to the local school board. The Union will be afforded ten (10) work days to submitwritten comments if it chooses. Management agrees to give the Union’s commentsconsideration; and, if comments are made, the Union will receive a written explanation for theactions that are taken, or not taken. Management and the School Board are recognized as havingthe final decision.B. For higher education, academic calendars will be submitted to the Union national <strong>of</strong>fice andlocal steward at the same time they are provided to the Board <strong>of</strong> Regents.C. For BIE schools within close proximity to public schools, efforts will be made for the BIE schoolcalendar to coincide as nearly as possible with the local public school calendar.Section 3. Formula FundingThe <strong>Bureau</strong> will consult with the Union concerning changes to the <strong>Indian</strong> School Equalization Formulaused to fund <strong>Bureau</strong> schools under P. L. 95-561. The Union shall have an opportunity to make writtencomments. If the Union makes comments, the <strong>Bureau</strong> will give the Union a written explanation <strong>of</strong>actions taken that change the Formula. Management is recognized as having the final decision.112
