Article 31Education ActivitiesSection 1. Classroom ActivitiesA. Teachers shall be afforded the right to maintain discipline in accordance with the policies of thestudent handbook established at the school.B. Any person at the school or on its grounds whose behavior is a threat to the safety and/or healthof others will be reported to the appropriate supervisor. Management will take whatever steps areavailable to protect students and staff.C. Each school is by statute required to have a code of student conduct. This code of conduct shouldbe developed by students’ administrators, the Union, staff, and the appropriate school board andin the interest of all concerned should be strictly enforced by appropriate officials. Thedeveloped code will conform to all applicable laws and regulations.D. Management will make every attempt to schedule administrative meetings before or after the endof the students’ instructional day.Section 2. School CalendarA. The appropriate school administrators will furnish the Union national office and the localsteward with the proposed school calendar for the next school year before submitting thecalendar to the local school board. The Union will be afforded ten (10) work days to submitwritten comments if it chooses. Management agrees to give the Union’s commentsconsideration; and, if comments are made, the Union will receive a written explanation for theactions that are taken, or not taken. Management and the School Board are recognized as havingthe final decision.B. For higher education, academic calendars will be submitted to the Union national office andlocal steward at the same time they are provided to the Board of Regents.C. For BIE schools within close proximity to public schools, efforts will be made for the BIE schoolcalendar to coincide as nearly as possible with the local public school calendar.Section 3. Formula FundingThe Bureau will consult with the Union concerning changes to the Indian School Equalization Formulaused to fund Bureau schools under P. L. 95-561. The Union shall have an opportunity to make writtencomments. If the Union makes comments, the Bureau will give the Union a written explanation ofactions taken that change the Formula. Management is recognized as having the final decision.112
