Article 4Employee RightsSection 1. Collective Bargaining RightsEach employee shall have the right to form, join, or assist any labor organization, or to refrain from anysuch activity freely and without fear <strong>of</strong> penalty or reprisal and each employee shall be protected in theexercise <strong>of</strong> such right. Except as otherwise provided under this Agreement, such right includes the right:A. To act for the labor organization in the capacity <strong>of</strong> a representative and the right, in that capacity,to present the views <strong>of</strong> the labor organization to heads <strong>of</strong> agencies and other <strong>of</strong>ficials <strong>of</strong> theExecutive Branch <strong>of</strong> the Government, the Congress, or other appropriate authorities; andB. To engage in <strong>collective</strong> <strong>bargaining</strong> with respect to conditions <strong>of</strong> employment throughrepresentatives chosen by employees under this Agreement.Section 2. Voluntary DuesNothing in the Agreement will require an employee to become or remain a member <strong>of</strong> a labororganization or to pay money to the organization except pursuant to a voluntary written authorization bymembers for payment <strong>of</strong> dues through payroll deduction or by voluntary cash dues payment by amember.Section 3. AccountabilityA. Employees are accountable for performance <strong>of</strong> <strong>of</strong>ficial duties and compliance with Standards <strong>of</strong>Conduct for Federal employees as codified as well as applicable DOI policies. Employees shallhave a right to engage in outside activities <strong>of</strong> their choosing without being required to report toManagement except as required by law or regulations or outside employment activities that maybe a conflict <strong>of</strong> interest to their federal positions. A conflict <strong>of</strong> interest is a situation in which anindividual has competing interests or loyalties. Management retains the authority to takeappropriate actions should it be determined that an employee’s <strong>of</strong>f-duty conduct affects his or herability to meet the position’s requirements or the employee’s activities undermine the public trustor otherwise affect the efficiency <strong>of</strong> the service. This does not diminish Management’s right toassign <strong>of</strong>ficial duties in accordance with applicable laws and regulations.18
