Article 32Reduction-in-Force (RIF)/PlacementSection 1. PolicyThrough careful planning and use <strong>of</strong> other administrative techniques, to the extent it determinespracticable and in the public interest, Management <strong>of</strong>ficials at all organizational levels should seek toavoid the necessity <strong>of</strong> entering into a formal reduction-in-force (RIF) action. Management will conduct aRIF only when the release is necessary for the reasons specified in Office <strong>of</strong> Personnel Management(OPM) regulations, 5 CFR, which includes lack <strong>of</strong> work, shortage <strong>of</strong> funds, insufficient personnelceilings, reorganizations, reclassification due to a change in duties, or the exercise <strong>of</strong> reemploymentrights or restoration rights. OPM regulations will be observed by Management and the Union incarrying out their responsibilities throughout the RIF process. The provisions <strong>of</strong> this Article will apply toall RIF or transfer <strong>of</strong> function actions affecting unit employees under 5 CFR.Section 2. ProcedureA. Union Notification. When it is anticipated that a transfer <strong>of</strong> function out <strong>of</strong> the commuting areaor reduction in force affecting <strong>bargaining</strong> unit employee(s) will be necessary, the Union will begiven preliminary notification in writing. This notification will be given within seven (7) workdays <strong>of</strong> approval by Central Office, unless circumstances dictate otherwise, and will include thefollowing:(1) The reason for the reduction in force or transfer <strong>of</strong> function as shown in the originalrequest and approval;(2) The approximate number <strong>of</strong> positions that may be affected initially;(3) The competitive areas that may be involved in a reduction in force; and(4) The anticipated effective date that the RIF or transfer <strong>of</strong> function will take effect; and(5) Copy <strong>of</strong> agency internal RIF procedures (See Appendix N).B. Performance Ratings. At the time the Union receives its preliminary notification <strong>of</strong> ananticipated RIF, Management will provide the Union with a list <strong>of</strong> all employees covered by thenotice whose current annual performance ratings <strong>of</strong> record are overdue, if performance ratingsare a factor in the RIF.C. Union Contact. The Union will appoint a local contact at the level where the RIF will take placefor the purpose <strong>of</strong> ensuring compliance with regulations. Prior to implementation <strong>of</strong> a RIF, theUnion will receive a copy <strong>of</strong> such proposed action, including the reason for the RIF.116
