Section 14. Pay Setting PracticesA. Additional credit hours in education from an accredited institution can be submitted to theHuman Resources Office to qualify the Employee for increases on the pay scale. Documentssubmitted by October 1st <strong>of</strong> the <strong>contract</strong> year will be credited as <strong>of</strong> the first day <strong>of</strong> the <strong>contract</strong>.Documents submitted after October 1st will be credited as <strong>of</strong> the date processed by the HumanResources Office.B. For any employee in a BIE school which is near one or more surrounding public school systemsthat pay a corresponding wage which is higher than the BIE school, Management will considerpaying a post differential for those locations to equalize pay as compared to the local publicschool district, in accordance with 25 USC Section 2012(g)(2). If denied, an explanation will beprovided to the employee and the Union.C. Within thirty (30) calendar days <strong>of</strong> the effective date <strong>of</strong> this <strong>agreement</strong> and prior to the beginning<strong>of</strong> each school year where there has been a significant increase or decrease in staffing (plus orminus 10%), the parties shall meet to review the attrition/retention statistics for each school, andother conditions <strong>of</strong> environment or work (such as geographic isolation or unusually difficultenvironmental working or living condition) that may warrant additional pay (post differential)authorized by 25 USC section 2012(g)2) as a recruitment and retention incentive.D. Before any rate <strong>of</strong> compensation or annual salary rate is established pursuant to 25 USC Section2012(g)(2) that is lower than the rates that are payable under the Defense Department OverseasTeachers Pay and Personnel Practices Act, the Union will be given notice and an opportunity tobargain over said rates.E. No rate <strong>of</strong> compensation or annual salary rate for new hires established pursuant to 25 USCSection 2012(g)(C) that is lower than the rates that are payable under the Defense DepartmentOverseas Teachers Pay and Personnel Practices Act shall be applied to employees who arealready working at the school.F. In the event that the adoption <strong>of</strong> new rates <strong>of</strong> compensation or annual salary rates under 25 USCSection 2012(g)(C) leads to an increase in the payment <strong>of</strong> compensation above that whichemployees had been previously paid, such rates shall be made applicable in their entirety toemployees already teaching at the school.G. Except for employees occupying positions <strong>of</strong> teachers and counselors, including dormitorycounselors and homeliving counselors, adjustments in an employee’s basic compensation madein connection with each <strong>contract</strong> renewal will be based on the following:(1) Each employee with a minimum rating <strong>of</strong> Fully Successful on his/her EmployeePerformance Appraisal Plan whose <strong>contract</strong> is renewed shall receive one pay incrementfor longevity until he or she reaches the highest increment <strong>of</strong> his or her salary level; and108
