Article 25Grievance ProcedureSection 1. PurposeThe negotiated grievance procedure (NGP) provides a mutually acceptable method for prompt andequitable resolution <strong>of</strong> grievances for <strong>bargaining</strong> unit employees. It is the intent <strong>of</strong> the Parties to resolvegrievances informally at the earliest possible time and at the lowest possible level. This negotiatedprocedure shall be the sole and exclusive administrative procedure available to employees for settlement<strong>of</strong> grievances.Section 2. DefinitionA. Grievance means any complaint:Section 3. Exclusions(1) By any <strong>bargaining</strong> unit employee concerning any matter relating to their employment; or(2) By the Union concerning any matter relating to the employment <strong>of</strong> any <strong>bargaining</strong> unitemployee; or(3) By any <strong>bargaining</strong> unit employee, the Union, or Management concerning:a. The effect or interpretation or a claim <strong>of</strong> breach <strong>of</strong> this Agreement; orb. Any claimed violation, misinterpretation <strong>of</strong> any law, rule or regulationaffecting conditions <strong>of</strong> employment.The following matters are excluded from coverage under the grievance procedure and will be rejected ifgrieved. However, questions concerning application <strong>of</strong> procedures may be addressed by the Unionrepresentative to the <strong>Bureau</strong> Labor Relations Officer or designee.A. Matters relating to prohibited political activities (5 USC, Section 7321);B. Retirement, life insurance, or health insurance;C. Examination, certification or appointment;D. Non-selection for promotion from lists <strong>of</strong> properly ranked and certified candidates;E. Non-selection for detail;F. Furloughs <strong>of</strong> employees under appointments subject to furlough;83
