In no case will theeffective date <strong>of</strong> an adverse action be sooner than thirty (30) days from the date <strong>of</strong> the proposal.Section 5. Crime Provision and Indefinite SuspensionA. Crime Provision: If the <strong>Bureau</strong> has reasonable cause to believe that the employee has committeda crime for which a sentence <strong>of</strong> imprisonment may be imposed, the required thirty (30) dayadvance written notice period before imposition <strong>of</strong> an adverse action may be shortened.B. Indefinite Suspension: Management may impose an indefinite suspension for the reason noted inparagraph 5.A. above. The reasonable cause requirement may be satisfied by such things as anindictment (or a similar judicial finding) or a separate investigation. Management mayinitiate/continue an indefinite suspension under the following, but not limited to, circumstances:(1) When the <strong>Bureau</strong>/Office is contemplating further action and has advised the employee <strong>of</strong>the possibility <strong>of</strong> further action;(2) When the <strong>Bureau</strong>/Office takes final action within a reasonable period after the resolution<strong>of</strong> criminal charges.C. The indefinite suspension is grieveable or appealable to MSPB.79
