Article 13Workweek and Hours <strong>of</strong> WorkSection 1. HoursA. For purposes <strong>of</strong> determining eligibility for overtime pay, the basic workweek shall normallyconsist <strong>of</strong> forty (40) hours over five (5) consecutive eight-hour days. The workweek will be theperiod for which an employee is paid a straight-time pay rate. Management recognizes the right<strong>of</strong> the Union to bargain over the impact and implementation <strong>of</strong> changes in the hours <strong>of</strong> work,shifts, flextime or tours <strong>of</strong> duty.B. In conformance with the Federal Employee Part-time Career Employment Act (FEPCEA),Management shall not abolish any position occupied by an employee in order to make the duties<strong>of</strong> such position available to be performed on a part-time career employment basis. Nor shall anyunit employee who is employed on a full-time basis be required to accept part-time employmentas a condition <strong>of</strong> continued employment. However, this paragraph does not impact part-timecareer positions which exist at the time this Agreement is memorialized or preclude Managementfrom the creation <strong>of</strong> part-time career positions which are established in accordance withFEPCEA.Section 2. Alternative Work Schedules (AWS)A. General(1) Management and the Union agree to support the application <strong>of</strong> alternative work scheduleswithin various organization segments <strong>of</strong> the Department. Both parties further agree thatit is the mutual responsibility <strong>of</strong> Management and employees to effectively andefficiently accomplish the mission <strong>of</strong> the Department. The alternative work schedulesdefined in this section are recognized by the parties as exceptions to the basic work weekdefinition identified in Section 1 above.(2) Alternative work schedules will fall into two categories: flexible work schedules (FWS)and compressed work schedules (CWS).B. Definitions and Administration(1) If approved by Management, employees may elect to work one <strong>of</strong> the following alternatework schedules:a. Flexible Work Schedules: An FWS allows variable hours (within designatedflexible time bands) and variable days, with set core hours. Employees, with theexception <strong>of</strong> members <strong>of</strong> the Senior Executive Service, may earn credit hoursunder an FWS.43
