(4) Needed action(s) to obtain minimally successful level <strong>of</strong> performance;(5) Provisions for counseling, training, or other appropriate assistance, if any; and(6) Warning concerning the consequences <strong>of</strong> continued performance below the MinimallySuccessful (“acceptable”) level.B. The goal <strong>of</strong> a PIP is to give the employee an opportunity <strong>of</strong> at least thirty (30) calendar days todemonstrate acceptable (Minimally Successful) performance in all critical elements. ForContract Education employees, the opportunity to improve will occur while the employee is in aduty status.C. If, at any time, the supervisor determines the employee has demonstrated acceptable performancethe PIP may be terminated. The employee will be notified, in writing that the PIP has beenterminated and he or she has been evaluated as at least Minimally Successful in the criticalelement.D. If the employee is demonstrating some improvement but has not yet achieved acceptableperformance, the PIP may be extended for additional thirty (30) or more calendar days. ContractEducation Employees may be given no more than one (1) <strong>contract</strong> term to raise the summaryrating to Minimally Successful. A second consecutive rating <strong>of</strong> Unsuccessful shall result inremoval or non-renewal <strong>of</strong> the Contract Education employee. Removal <strong>of</strong> non-probationaryemployees for inadequate performance under 5 CFR 432 shall not occur unless a PIP has beenimplemented.E. Failure <strong>of</strong> the employee to correct performance deficiencies during the PIP will result in theemployee receiving an Unsuccessful Rating. Demotion, removal, or <strong>contract</strong> non-renewal <strong>of</strong> theemployee, whichever is appropriate, will be taken. Non-renewal <strong>of</strong> non-probationary ContractEducation employees is subject to Management appeal process pursuant to Article 30 Section 4.F. The employee may appeal to either the Merit Systems Protection Board (MSPB) in accordancewith applicable law or file a grievance under the negotiated grievance procedure. ContractEducation employees may not appeal to MSPB but may only file a grievance under thenegotiated grievance procedure.Section 6. Group Sessions and TrainingWhen local training on the <strong>Bureau</strong>s’/Offices’ performance appraisal system is provided to managersand/or supervisors, <strong>bargaining</strong> unit employees and employees <strong>of</strong> the Union may be given theopportunity to attend.75
