Section 13. Step 3 GrievancesIf the grievant does not accept the written decision at Step 2, a Step 3 grievance may be filed within ten(10) work days <strong>of</strong> receipt <strong>of</strong> the written decision with the next level supervisor, as appropriate or asdesignated. The grievance will proceed through the chain <strong>of</strong> command no further than the <strong>of</strong>ficial thathas both proposing and deciding authority on disciplinary matters. Either Party may request a meeting orconference call be held to discuss the grievance.Section 14. Response to Step 3Management must render a written decision within ten (10) work days from receipt <strong>of</strong> the Step 3grievance. The decision will include the Union’s right to request Arbitration. (See Article 26, Section 5,Invoking Arbitration)Section 15. Expedited Grievance ProcedureParties may mutually agree on a case-by-case basis to waive any step <strong>of</strong> the grievance procedure.Section 16. Management GrievancesManagement may file grievances against the Union within fifteen (15) work days <strong>of</strong> the incident or thedate Management could be expected to be aware <strong>of</strong> the matter. Management shall bring the matter to theattention <strong>of</strong> the Union President or designee, who shall render a decision in writing within ten (10) workdays.Section 17. Union GrievancesA. A union grievance is a grievance as defined in Section 2.A. <strong>of</strong> this article, i.e., any allegation bythe Union concerning any matter related to the employment <strong>of</strong> any <strong>bargaining</strong> unit employee,group <strong>of</strong> employees, or the Union, concerning the effect, interpretation <strong>of</strong>, or a claimed breach<strong>of</strong>, this Agreement; or any claimed violation or misinterpretation <strong>of</strong>, any law, rule or regulationeffecting conditions <strong>of</strong> employment <strong>of</strong> <strong>bargaining</strong> unit employees, in which the Union is theGrievant although the allegation <strong>of</strong> a violation may impact the working conditions <strong>of</strong> one ormore <strong>bargaining</strong> unit employee(s).B. Union grievances which involve a matter that has arisen solely in one <strong>of</strong> the four<strong>Bureau</strong>s/Offices in the unit (BIA, BIE, OST, or AS-IA) shall be filed by the Union’s President ordesignee with the respective <strong>of</strong>fice director: Director <strong>of</strong> the BIA, Director <strong>of</strong> the BIE, the SpecialTrustee, or the Assistant Secretary. Union grievances which involve a matter that has arisen inmore than one <strong>of</strong> these organizations shall be filed with the senior management <strong>of</strong>ficial deemedappropriate as captured in <strong>of</strong>ficial AS-IA, BIA, BIE, or OST organizational charts normallyfound in the 100 series <strong>of</strong> the Departmental Manual. Unless they are continuing in nature, Uniongrievances shall be filed within fifteen (15) work days <strong>of</strong> the incident or the date the Union couldreasonably be expected to be aware <strong>of</strong> the matter. Management shall render a decision in writingwithin ten (10) work days.88
