Section 3. Shift AssignmentsShift assignments will be made in the interest <strong>of</strong> efficiently carrying out program objectives. To themaximum extent possible, personal hardships or preferences expressed by employees will be consideredin assigning tours <strong>of</strong> duty. To the extent that employees have substantially equal qualifications, asdetermined by Management, the most senior employee may have first choice <strong>of</strong> shift assignment, or inthe case <strong>of</strong> instructional personnel, first selection <strong>of</strong> courses to be taught and teaching schedules.Section 4. Rest BreaksAll covered employees will receive a 15 minute rest break mid-morning and mid-afternoon. In addition,employees will be authorized a 15 minute rest break for each four hour period <strong>of</strong> overtime worked. Thetwo fifteen minute rest breaks cannot be used to shorten the work day. If the rest break is not utilized, itis lost. It is Management’s responsibility to schedule rest breaks and find coverage. Employees may notleave the duty station during rest breaks.Section 5. Meal TimeEmployees not on AWS shall receive a minimum <strong>of</strong> 30 minutes and up to one hour for a meal time orunpaid break, except in emergency situations. The employee shall be free to leave the worksite duringthis period since the meal time/unpaid break is not paid time. For employees scheduled to work duringcore hours, the meal time/unpaid break must be taken <strong>between</strong> 11:00 am and 2:00 pm. The meal timeor unpaid break may not be taken at the beginning or at the end <strong>of</strong> the normal scheduled workday. Normally, duties will not be assigned during the meal time/unpaid break. If duties must beassigned, the employee will be compensated with overtime or compensatory time as appropriate. For<strong>contract</strong> Education employees, see Article 31, Section 5.Section 6. HolidaysEmployees are entitled to all federally recognized holidays if otherwise in a duty status. Employeesproperly classified as “essential” may not always be entitled to be <strong>of</strong>f on all federally recognizedholidays, but will be compensated in accordance with appropriate pay regulations.Section 7. Altering SchedulesExcept where the needs <strong>of</strong> the service dictate otherwise, assignments to tours <strong>of</strong> duty will be scheduledat least one week in advance <strong>of</strong> the administrative workweek and such schedules will remain in effectfor at least one week.48
