Section 4. School BoardsIn accordance with 25 CFR 38.10(a): “School Boards may not direct, control, or interrupt the day-to-dayactivities <strong>of</strong> the <strong>Bureau</strong> <strong>of</strong> <strong>Indian</strong> Affairs employees carrying out <strong>Bureau</strong> operated education programs.”Management will grant <strong>of</strong>ficial time for the Chief Steward or designee to attend both local school boardmeetings as an observer, when school board meetings are held during regular duty hours.Section 5. Lunch PeriodsA. BIE supports a duty-free lunch period for employees. Teachers, education assistants, andcounselors will normally not have assigned duties during their lunch period. In cases whereduties must be assigned, employees will be compensated with compensatory time, overtime or ashortened work day (straight eight hours) at the employee’s discretion.B. When an employee is required to work through lunch while supervising or instructing students,lunch will be provided at no charge.Section 6. Teaching AssignmentsA person currently under <strong>contract</strong> or employed as a teacher who indicates in writing an intention toreturn to the same school for a succeeding year will be notified <strong>of</strong> the specific teaching assignment to theextent known at the time <strong>contract</strong>s are <strong>of</strong>fered. Management will solicit the employee’s preference for agrade level assignment and subject matter, and should make an effort to accommodate that preference.Should a change in the assignment become necessary, the teacher will be informed as soon asManagement determines a change is needed and given sufficient time, two week minimum unless thereare unforeseen circumstances, for curriculum preparation. This section also applies to instructors inhigher education.Section 7. Inclement Weather ConditionsSee Article 17 Section 10Section 8. InterruptionsThe Parties recognize classroom interruptions as detrimental to a good learning environment and thecontinuity <strong>of</strong> a well-planned classroom operation. Therefore, staff and administrators accept the jointresponsibility to minimize such interruptions.Section 9. Emergency ConditionsSee Article 17, Section 10Each school must maintain an Emergency Plan.113
