CHAPTER II - THE ADMINISTRATIVE MACHINERY1. <strong>Election</strong> <strong>Commission</strong> of IndiaArticle 324 of the Constitution lays down, inter alia, that the superintendence, directionand control of the preparation of the electoral rolls <strong>for</strong> all elections to the Parliament andto the Legislature of every State shall be vested in the <strong>Election</strong> <strong>Commission</strong>.2. Chief <strong>Electoral</strong> OfficerUnder Section 13 A of the Representation of the People Act, 1950, there shall be aChief <strong>Electoral</strong> Officer (CEO) <strong>for</strong> each State/Union Territory. He is an Officer of theGovernment designated or nominated by the <strong>Election</strong> <strong>Commission</strong> in this behalf inconsultation with the State Government. Subject to the superintendence, direction andcontrol of the <strong>Election</strong> <strong>Commission</strong>, the Chief <strong>Electoral</strong> Officer shall supervise thepreparation and revision of electoral rolls of all the constituencies in the State.3. District <strong>Election</strong> <strong>Officers</strong>3.1 Section 13 AA of the Representation of the People Act, 1950 provides <strong>for</strong> theappointment of a District <strong>Election</strong> Officer in each district who shall be an officer ofGovernment. Normally the District Collectors / District Magistrates / Deputy<strong>Commission</strong>ers are designated and notified as the District <strong>Election</strong> <strong>Officers</strong> (DEO) oftheir districts. However, there may be some exceptions to this normal practice due toadministrative reasons.3.2 Subject to the superintendence, direction and control of the Chief <strong>Electoral</strong>Officer, the District <strong>Election</strong> Officer shall coordinate and supervise all work in the districtor in the areas within his jurisdiction in connection with preparation and revision ofelectoral rolls <strong>for</strong> all Parliamentary, Assembly and Council constituencies.3.3 Under the law, the <strong>Election</strong> <strong>Commission</strong> has the power to designate or nominatemore than one such officer <strong>for</strong> a district if the <strong>Commission</strong> is satisfied that the functionsof the office cannot be per<strong>for</strong>med satisfactorily by one officer.4. <strong>Electoral</strong> <strong>Registration</strong> <strong>Officers</strong>According to Section 13B of the Representation of the People Act 1950, the electoral roll<strong>for</strong> each constituency shall be prepared and revised by an <strong>Electoral</strong> <strong>Registration</strong> Officer(ERO), who shall be such officer of Government or of a local authority as the<strong>Election</strong> <strong>Commission</strong> may, in consultation with the State Government designate ornominate in this behalf. Normally, the civil service/revenue officers of Sub Divisional<strong>Officers</strong> (SDOs) or officers of equivalent status are appointed as the <strong>Electoral</strong><strong>Registration</strong> <strong>Officers</strong> <strong>for</strong> the Assembly Constituencies within their respective jurisdictionas far as practicable. In case sufficient number of SDOs are not available in a state <strong>for</strong>appointing as ERO then the officers of Tehsildar or equivalent status may also beconsidered The <strong>Electoral</strong> <strong>Registration</strong> <strong>Officers</strong> are permitted to deploy such persons asthey think fit, subject to such restrictions as may be imposed by the <strong>Commission</strong>, <strong>for</strong>10
